KYRA PHILLIPS, CNN ANCHOR: Well a new court date for Scott Peterson and apparently, he's not very happy about it. But attorneys for the man accused of killing his wife and unborn son say it can't be helped. CNN's Rusty Dornin brings us the latest now from Modesto, California -- Rusty.
RUSTY DORNIN, CNN CORRESPONDENT: Well, Kyra, as expected, the defense asked for a delay. And this really was a case of be careful of what you wish for because they originally said they weren't getting enough discovery, enough evidence from the prosecution. In court today, the defense said they received voluminous amounts of information on Friday, too much to be able to go through. It will take them days to go through the evidence and the CDs and the videotape that sort of thing.

Also, Mark Geragos is saying he has another court date in Los Angeles, he has to appear then. The prosecution said, Well, there's not much we can do about that so we're not going to fight this. So October 20 is the date.

Now as we know Scott Peterson was not very happy -- we learned that from sources -- about the delay of the preliminary hearing. He was urging his defense attorneys to go forward. But he did acquiesce when asked by the judge, he did say he was agreeable because he has to be asked whether he's agreeable to waive time.

Meantime, Laci Peterson and her unborn son Connor were laid to rest on Friday. There were funeral services. Not on the invitation list were Jackie and Lee Peterson, Scott Peterson's parents and the rest of his family. The Petersons saying they were hurt and angry they were not invited.

(BEGIN VIDEO CLIP)

JACKIE PETERSON, SCOTT PETERSON'S MOTHER: It was like kicking -- a kick in the gut, to see our grandson and daughter-in-law's funeral on -- well, we read it in the news, is where we saw it first. It just felt as if someone had hit us. It's unforgivable.

And I think Laci would have just been appalled. She would have never done that to us. She loved us. We loved her a lot. And we've only tried to help -- to work towards finding her -- and support in any way we could. Because it's -- it's just cruel.

(END VIDEO CLIP) DORNIN: After today's court hearing, Lee Peterson told reporters there were over 250 people invited to that memorial service. He doesn't understand why the grandparents of his unborn -- of the unborn son Connor were not invited -- Kyra.

PHILLIPS: Rusty Dornin live from Modesto, thank you.
