Peterson Preliminary Hearing Rescheduled

MILES O'BRIEN, CNN ANCHOR: Now to Modesto, California, where the long-awaited preview of Scott Peterson's murder trial was wiped off next week's docket. It's now scheduled for October 20.
CNN's Rusty Dornin live from the courthouse with the ruling and the reason -- hello, Rusty.

RUSTY DORNIN, CNN CORRESPONDENT: Well, Miles, Scott Peterson, from what we understand from sources, was not happy about the delay in this preliminary hearing.

He had urged his defense attorneys to go ahead and go forward with it. But, again, it has been delayed until October 20. And the reason is that the defense is now claiming they have too much evidence that was delivered to them on Friday, boxes and C.D.s and videotapes, just too much for them to go through in the next week.

But the deciding factor, really, was that Mark Geragos, the lead attorney, has another court case in Los Angeles next week. The prosecution said, well, there's nothing we can do about that. We will not fight it.

So the preliminary hearing will take place next month. Meantime, Laci Peterson and her unborn son, Connor, were laid to rest last week. There were funeral services. Not on the invitation list were Peterson's family. Jackie and Lee Peterson, Scott's parents, say they are troubled by the fact that they were not invited.

LEE PETERSON, FATHER OF SCOTT PETERSON: It was a chance to -- I don't know -- kind of put an end to things, to see them both in a place of rest. And to not have that opportunity, yes, it wasn't what we wanted, for sure.

QUESTION: Was it the wrong thing to do? Should you have been invited?

PETERSON: I'm not going to say that. I don't -- it's not something I would have done. I would have -- if 250 other people can attend, surely, there would be room for the grandparents of that baby.

DORNIN: And his wife, Jackie Peterson, expressed a little stronger sentiment. She said it felt like a kick in the stomach not to be invited to those services. Laci and her unborn son were buried a short ways away from Modesto -- Miles.
