Court Clears California Election

KYRA PHILLIPS, CNN ANCHOR: In California today Governor Gray Davis is doling out driver's licenses to illegal immigrants while Arnold Schwarzenegger says he'll try to take them all back, if he is elected governor. Our national correspondent Bob Franken covering the recall which got the go ahead from some federal judges today. Hi, Bob.
BOB FRANKEN, CNN NATIONAL CORRESPONDENT: Hello, Kyra. And Arnold Schwarzenegger when he's criticized for that for being anti- immigrant says that he is the only real immigrant among the major contenders for the replacement for Governor Davis, if in fact Governor Davis is recalled.

As far as the election going forward, one of the impediments that remained seems to have been over come. It was a three-judge panel that held a hearing in San Jose today to decide that the Justice Department has given the adequate approval that is needed to proceed with the election. So the judges are in the process now of writing their opinion on the matter, but they're not going to delay things.

That leaves a September 11 hearing by the appeals court in Pasadena, the federal appeals court that will be hearing an ACLU appeal of a lower judge court saying that they should not go, in fact, they should not delay the election.

So at the moment the election was proceeding smoothly. And of course that means that we're continue to focus on Arnold Schwarzenegger. Of course, he is going to be the target this evening of some demonstration by some women's groups who believe that he is anti-women, that he has made comments over the years that are degrading to women.

Today at an event Schwarzenegger was asked about this in Orange County. He said, first, talk to the people who worked with him and for him and they would vouch for him. And then of course he addressed those provocative comments that appeared in "Oui" magazine 26 years ago.

ARNOLD SCHWARZENEGGER (R), CALIF. GOV. CANDIDATE: So we try to get attention in headlines and we say things that many times that were exaggerated or not true just to get the headlines.

But the fact of the matter is, you have to forget about the '70s. I was a different person then. Today we have to look at the future which is the of this state. It's not what was said in the '70s by me that has is what ruined the California economy. What has ruined the California economy is Bustamante and Gray Davis. They're the twin terminators of Sacramento.

FRANKEN: Nevertheless, a persistent issue in this campaign has been what Schwarzenegger says and what he doesn't say. He said at the beginning of the campaign that he would be accepting no special interest money, only to get it known that he is taking money from corporations.

Yesterday Schwarzenegger said it was my mistake because I was not articulate enough to explain that. And you can imagine that his opponents are going to be jumping all over that -- Kyra.
