The Peterson Case

KYRA PHILLIPS, CNN ANCHOR: Mike Brooks join us now to talk about what's happening inside that courtroom. It's been about 45 minutes. What are they discussing?
MIKE BROOKS, CNN CORRESPONDENT: They started off talking about admissibility of evidence. They started off talking about admissibility of the global positioning evidence, and again, of this hair they're talking about.

Now, they're flying in an FBI expert in DNA from the FBI lab in Quantico, who has examined this hair. Now the defense is saying the mitochondrial DNA is not as accurate as other forms of evidence. So most likely this will be allowed in.

But they've also talked about wiretaps. And also, they talked about Laci Peterson's sister, Amy Rocca. The prosecutor want her to be allowed in. They're asking for the defense on their position. The defense is saying they don't have a problem with it, as long as the family does not discuss among themselves the proceedings going on before anyone testifies. You know, again, on some of the witness, the family is allowed to be in there and some of the family may be called as witnesses.

LIN: Now this hair, is this hair that was found in the boat, or...

BROOKS: This was hair that was hair that was found on a pair of pliers in Scott Peterson's boat. Now, as we know, Laci apparently did not know he even had a boat and had never been in the boat, supposedly. They're saying they believe that the police department did not handle this evidence right. That will be brought up. I'm sure that will be a point of contention over the next number of days. The preliminary hearing is expected to last until Tuesday.

LIN: Meanwhile, Gloria Allred, she's representing Amber Frey, the woman with whom Scott Peterson had an affair. She got kicked out of the courtroom?

BROOKS: Well, they were try to have her excluded from the courtroom. They thought that having Gloria Allred in the courtroom, since she is the attorney for a potential witness that is expected to testify in the preliminary hearing -- Amber Frey -- they thought -- Geragos said, he did not want her in there because he was afraid she would discuss it with her client. The judge has ruled that she can remain in the courtroom as long as she does not discuss any of the testimony. So far, in the preliminary hearing with her client.
