Peterson Hearing

KYRA PHILLIPS, CNN ANCHOR: Accused wife killer Scott Peterson is back in court this hour after getting a day off while his attorney tended to another murder trial. The hearing will determine if Peterson can be tried for the killing of his wife and unborn child. Still on hold, testimony from Peterson's former lover, Amber Frey. But there is plenty being said on the stand today.

MIKE BROOKS, CNN CORRESPONDENT: Good afternoon, Kyra.
Well, court was back in session at about 12:30 Eastern Time today. As Scott Peterson entered the courtroom, he looked at his parents, smiled, and his mother said, "I love you, Scott."
And then, on the stand a little bit later on was Detective Al Berkoni (ph) of the Modesto Police Department. They established that consent was given by Scott Peterson to search his house, his warehouse, his car and Laci Peterson's Land Rover. Also discussed was the walk-through of the house, exactly what detectives saw as they walked through the house with Scott Peterson.
They also said they looked at Scott's cell phone. They looked at the numbers -- they testified that they looked at the numbers that had been dialed, the calls that had been received on Scott's cell phone. And the prosecution asked Detective Berkoni (ph) if a certain number was given to them by Scott Peterson. They said, no. Apparently that number is a second cell phone that Scott Peterson had that he did not tell investigators about at that time.
They also talked about the search of when they looked in Scott's truck. Inside the truck they found a box of fishing lures that had never been opened. They also found a fishing license that expired back in 1999, as well as a .22-caliber semiautomatic handgun that had a full magazine but no round in the chamber. We do not know if that gun is connected in any way to this particular case.
They also talked about MacKenzie (ph), the Peterson's dog. The detective testified that Scott told him that MacKenzie (ph) was very protective of Laci, especially when someone got near her.
They also talked about the conversation that detectives had with Scott the night he reported Laci -- that she disappeared. One of the questions that were asked, Kyra, by the detectives of Scott Peterson was: Are you having an affair? And Scott Peterson told detectives at that time, no, he was not -- Kyra.
