Kobe Bryant Defense Fights For Accuser's Medical Records

KYRA PHILLIPS, CNN ANCHOR: Some developments in the Kobe Bryant sexual assault case. Among them, the defense says it was given the wrong medical records of the woman who alleges she was raped by Bryant. The judge orders those records destroyed. The records did not directly relate to the rape charge, though.
Joining us with the latest from Eagle, Colorado, CNN's Josie Burke. She's going to sort it all out.

Hi, Josie.

JOSIE BURKE, CNN CORRESPONDENT: Hi, Kyra. I'm going to try.

The big question that were looking at going into today was, would the defense gain access to the accuser's medical records? And now we come to find out that they already did have some access to the alleged victim's medical records. And now we have to try to figure out how this happened.

In the courtroom today, a representative from Valley View Medical Center said that, instead of sending along to the prosecution and the defense a copy of the rape exam that was done after the alleged attack on July 1, the hospital sent along instead a copy of a report from a May 30 visit that the accuser made to the emergency room at the same hospital. That's probably why it's appeared in so many motions that the defense has a lot of information about the accuser's medical history.

In particular, they talk with great detail about a purported suicide attempt a month before the alleged incident. It's likely that they got that information from the report that was sent erroneously. So, today, the judge has said that that report that they did get in error, they need to destroy before the next hearing and that they can't use any information that they culled from it in the hearing that's going to take place this afternoon behind closed doors, when the defense is expected to call some witnesses and try to convince the judge that they should have access to a number of different medical reports, reports of the history of her medical history and her mental health history as well -- Kyra.
