LEON HARRIS, CNN ANCHOR: We wanted to show you a picture that we're getting in from Denver. We were getting a live picture moments ago, of Timothy McVeigh's lawyers, who were leaving their offices in Denver to go over to the courtroom to file papers, again, to try to press the case to get a stay of execution.
This is a live picture we have coming in, of the lawyers. They are walking from one building to the next in the court complex. There you see them carrying the boxes containing all their filings.
Susan Candiotti is standing by. She's been trying to get ahold of some of these lawyers -- Susan.
SUSAN CANDIOTTI, CNN CORRESPONDENT: Hi, Leon.
You just saw a live picture of Christopher Tritico, one of four members of Timothy McVeigh's defense team, carrying what you saw to be a large and appearing to be a very heavy box of written materials. He walked up the steps of the 10th Circuit Court of Appeals. This is after he filed a formality, a notice of appeal, with the district court across the street. That is where the trial took place.
And now they have taken the next step, which is to file their brief, which, we are told, is less than 20 pages in length, with the 10th Circuit Court of Appeals.
It is up to the clerk there to distribute this brief to the judges who will be hearing this case. We don't know which judges will be hearing it. We are told that that's the procedure here.
Once they are through, they will look over the document, and they will decide what to do next -- Leon.
HARRIS: At this point, we're still expecting they will be in that building for some time, and then they will be coming out to speak to the press, correct?
CANDIOTTI: That is correct. We don't know how long it will take him to file the paperwork, but when he is done, he will come outside, walk down those steps, and we have microphone set up. They did tell us that they would speak to elaborate on what exactly their legal argument will be, what points they are making before this court to try to win a stay of execution.
If they are not successful here, the current plan is to go to the U.S. Supreme Court, yet they have to get through this first step.
HARRIS: Getting on just a matter of hours now.
Susan Candiotti, thanks for that quick heads-up. We'll get back to you once we see them leave that courthouse and come back out to the press and talk to you.
