Judge in Modesto, California Considering Gag Order in Murder Trial of Scott Peterson

BILL HEMMER, CNN ANCHOR: A judge in Modesto, California still considering a gag order in the murder trial of Scott Peterson. He may soon also decide on releasing police reports and arrest warrants and autopsy results about Laci Peterson and her unborn child.
David Mattingly live in Modesto tracking the very latest on this yet again today -- David, good morning.

DAVID MATTINGLY, CNN CORRESPONDENT: Good morning, Bill.

There are some new reports this morning of new sorts of contention between Laci Peterson's family, the Roches, and Scott Peterson's family. The Roches complaining that they cannot get access to the house that Laci Peterson had shared with her husband Scott because the locks have been changed. They want to get in there to get some of her belongings like her wedding dress and some other items, like gifts they have given her and other things that they want to retrieve so that they can remember Lacy.

But they cannot get in because the locks have been changed and they've acquired attorneys in order to negotiate access.

Scott Peterson's attorneys say they hope they can work something out soon on that, but they don't want any items removed while they continue their own investigation.

All of this going on while Scott Peterson's attorneys are also looking over the records of 69 wiretaps, of 69 conversations that Scott Peterson had with his attorneys. These wiretaps conducted by investigators in this case. They had some very strong language yesterday in some court documents that were released, accusing prosecutors of prosecutorial misconduct. And we're also waiting to find out how they plan to respond once they've looked over whatever records there are of those 69 calls -- Bill.

HEMMER: David, bottom line, when could a judge make a call on the things like the arrest warrants, the autopsy, etc.?

MATTINGLY: It's supposed to be some time this week. But he said in court very early on that he is inclined not to let the public take a look at those. Everyone very concerned right now with all the pretrial publicity in this case, concerned about whether or not Scott Peterson will be able to get a fair trial.

That's why he's also discussing the possibility of a gag order, which could be decided next week. HEMMER: Thanks.
