DARYN KAGAN, CNN ANCHOR: We move on to California, where a court there will hear arguments today about the murder case against Scott Peterson. The rulings could determine how much the public will know about the case.
Elaine Quijano is live this morning in Modesto -- Elaine, good morning.
ELAINE QUIJANO, CNN CORRESPONDENT: Hello to you, Daryn.
Well, there are three big issues on the schedule for this morning -- wiretaps, autopsy results and a possible gag order.
Now, first on those wiretaps, those 69 intercepted phone calls between Scott Peterson and members of his defense team. His lawyers say that some of those intercepts may have violated attorney-client privilege. They want sanctions against the prosecution, even calling for them to be removed from the case.
But the D.A.'s office defends the use of those wiretaps and says that they were carried out according to the law.
The judge will also consider today a prosecution motion that the autopsy results on Laci Peterson and her unborn son Conner be unsealed. The prosecution essentially last week reversing its position in response to leaks to the media.
And finally, the judge will also look at imposing a possible gag order on all of the parties involved in this case. Again, the judge very concerned about pretrial publicity having and impact on Scott Peterson's ability to have a fair trial. The prosecution is in favor of a gag order, but both the defense and attorneys for Amber Frey are opposed to it. The defense saying it wants the chance to correct any misinformation out there and Amber Frey's attorneys saying that she should have the chance to go ahead and defend herself against any attacks on her reputation.
Amber Frey, of course, the woman who said that she had an affair with Scott Peterson.
A busy day ahead -- Daryn.
KAGAN: Elaine Quijano in Modesto.
Thank you so much for that.
