BILL HEMMER, CNN ANCHOR: Also from California, Soledad, political news out there, voters just about evenly split on whether or not to recall the Governor Gray Davis according to a new poll in "The L.A. Times" released late last night.
For more on that, to L.A. and Bob Franken, who's with us right now.

And, Bob, let's say good morning to you. Is this going to be all for naught based on these latest poll numbers?

Good morning.

BOB FRANKEN, CNN CORRESPONDENT: Well, it possibly could be. There's a growing feeling that all of this may, in fact, end up in Gray Davis not being recalled. And what's interesting not only is the fact that this new "L.A. Times" poll shows that there is as far as statistically concerned, a tie. 50 percent say that there should be a recall, 47 no, don't know, 3 percent. This poll has a plus or minus 3 percent variance anyway.

What's also interesting, which is not so obvious in the poll, is the fact that Gray Davis' disapproval rating has been going down. I know that sounds like a double negative, but it's really important. The last time, three weeks ago, he was at 72 percent. Now the disapproval is at 63 percent. And although that might sound dismal in normal circumstances, it marks a substantial improvement, which means that there is a trend going in Gray Davis' way.

Now, if in fact he is recalled, there's the battle for people who would replace him. That's, of course, really been a battle between three people. Now, the lieutenant governor, Cruz Bustamante, he came up with a 30-point rating this particular time. That's down 5 percent from the number that he had in the last "L.A. Times" poll. Arnold Schwarzenegger is up three, at 25. The one that's really interesting is Tom McClintock, the conservative Republican. He's really gone up, at six points now. That's at an 18. And there's quite a bit of pressure for him to get out of the race to clear the way for Schwarzenegger. Some people who think McClintock might be swaying to Schwarzenegger, get out of the way to clear it for him.

But of course what's really important to watch is the effort to recall Gray Davis, and one other thing, there's an appeals court hearing that was held yesterday, and the judges are deciding whether to delay the election. Their question suggested that they're at least considering that possibility -- Bill.
