California Recall Election

BILL HEMMER, CNN ANCHOR: To California also, a federal appeals court has the job of deciding whether or not that recall election will stay on hold or go as planned on the 7th of October. The court will hear arguments today in San Francisco. That's where Bob Franken is standing by in the Bay City.
Bob, good morning there.
BOB FRANKEN, CNN CORRESPONDENT: Good morning, Bill.
And we should note that the election if it goes forward, is just two weeks from tomorrow. So, the appeals court, which usually takes months to make ruling, is going to have to do so very quickly. This is the en banc hearing. It's an 11 judge panel. The court decided that the three-judge panel last Monday that ruled the election must stop had to have its decision reviewed. That oftentimes means that that would be reversed. We would expect there would be a hearing this afternoon, 1:00 pacific, by the way, 4:00 on the East Coast. It's going to be televised from the courtroom live. So it's going to be a very unusual hearing in that case. Of course, it's also unusual in the very content of the material. This recall election has been unusual since the beginning. It continues to be unusual.
As for the panel, this one, unlike the one that was appointed for the three-judge panel, is considered a moderate to conservative panel, if anything. Even though many of the appointees are Democrats. Eight of the eleven are Democrats, seven of them appointed by president Bill Clinton, but most of them are considered centrists. Many of the legal experts say that as a result, they think that there's a good chance that the earlier ruling will be reversed. If it is, the election goes forward.
We have a debate that is scheduled for Wednesday. That is the infamous debate where the questions are submitted in advance. There's a number of people who have said that perhaps the answers should be, too. That's the only one that Arnold Schwarzenegger is going to appear in. One other thing, this is the last day for voter registration for the election. People hope will go on. Most people now hope that it will go on, except for the plaintiffs in this case.
In order to qualify in California, you have to be a U.S. citizen, a resident of California, not on parole or in prison for a felony, and 18 by October 7th. I knew there'd be a catch somewhere.
HEMMER: One way or another we're getting closer to some sort of resolution. What that is, we'll wait.
