Friends Say Lindsay Lohan Called the Judge a F-king Bitch; Kyron`s Dad Says Stepmom is Involved

NANCY GRACE, HOST: Hollywood superstar Lindsay Lohan`s wild, erratic behavior crashes to an end behind bars. Lohan violates probation repeatedly, skipping mandatory alcohol counseling. Her ankle SCRAM alarm goes nuts, alerting alcohol use the night of the MTV Movie Awards. Thumbing her nose at the judge, Lohan parties at France`s Cannes Film Festival instead of showing up in court, claiming she lost her passport, blaming volcanic ash. Busted on video 2:00 AM in micro- mini hot pants on a multi-million-dollar yacht on the French Riviera.
Lohan breaking down in court, sobbing, begging, whining. And then in a disgusting display, Lohan sends a message straight to the judge, "F you" manicured onto her nails, nails she flashed at the judge throughout court.
Tonight, torpedo! A court report reveals Lohan positive for a cocktail of medications, painkiller Dilaudid, Adderall. Bombshell tonight. Lohan calls the judge, quote, "an F-ing B-I-T-C-H," Lohan vowing she will not go to jail, publicly comparing herself to an Iranian woman sentenced to death by stoning. As evidence emerges Lohan jerry- rigged that SCRAM anklet so she can booze it up and not get caught, Lohan claims cruel and unusual punishment -- get this -- citing the U.N.`s Declaration of Human Rights. Lohan`s lawyer throws in the towel!

MARSHA REVEL, LOS ANGELES SUPERIOR COURT JUDGE: Thirty days on jail on the reckless driving case, thirty days in jail on the first DUI case consecutive, and thirty days in jail on the second DUI case.
LOHAN: I wasn`t missing the classes.
REVEL: That`s 90 days in jail.
UNIDENTIFIED MALE: Breaking news. According to TMZ, Lohan plans to appeal the judge`s 90-day jail sentence. She allegedly told friends, quote, "I`m not going to jail."
LOHAN: (INAUDIBLE) my life!
UNIDENTIFIED FEMALE: There`s really no valid excuse.
LOHAN: I respect you!
UNIDENTIFIED MALE: This amid report that Lohan alleged referred to Judge Marsha Revel as a (EXPLETIVE DELETED) bitch.
UNIDENTIFIED MALE: Here`s what she tweeted a friend about the controversy surrounding her fingernails...
LOHAN: I respect you. I have been taking it seriously!
UNIDENTIFIED MALE: ... "Didn`t we do our nails as a joke with our friend, D.C. (ph)? It had nothing to do with court."
UNIDENTIFIED MALE: Lohan allegedly complained to friends that the judge hates her, was out to get her.
LOHAN: Honestly, it did wake me up (INAUDIBLE) scared me!
UNIDENTIFIED MALE: Lohan also allegedly said she doesn`t have a problem with drugs or alcohol.
UNIDENTIFIED FEMALE: So there`s alcohol and cocaine.
LOHAN: I wasn`t expecting any special treatment.

GRACE: And breaking news tonight, live, rural Oregon. Stepmommy walks a 7-year-old little boy down the hall of his elementary school from the science fair, he`s never seen again. Police insist stepmommy take a second polygraph. And in a stunning twist, 7-year-old Kyron`s dad files for divorce in secret, the court slapping stepmommy Terri Horman, the last person to see the boy alive, with an emergency restraining order. It gets worse! Stepmommy ordered to stay away from firearms and from her own children.
At police urging, Kyron`s dad moves out of the house, taking the 19-month-old baby sister with him, tonight hiding out at a secret location, secret even from Kyron`s stepmother. Kyron`s natural mother breaks down in tears in a public plea, begging stepmommy to help police, insisting the 7-year-old boy is still alive.
In another twist, a third mystery 911 call from inside the Horman home. The first 5:45 PM Saturday, emergency, dangerous threat. Daddy moves out within hours. Second 911 call, Terri Horman claims a man wants $10,000. We`re just hearing about that one. Third 911 call, midnight, child custody.
Bombshell tonight. Unsealed! We obtain that emergency restraining order stating in black and white Kyron`s father says stepmother Terri Horman is involved in Kyron`s disappearance and also that stepmommy tried to hire a hitman to kill Kyron`s dad just before the boy disappeared.
Police linking Terri Horman to the little boy`s disappearance. How -- how -- does a 7-year-old little boy go missing from his own elementary school classroom?

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight. Lindsay Lohan calls the judge, quote, "an F-ing B-I-T-C-H." No, it`s not just on her fingernails that she flashes at the judge throughout that hearing. She now calls the judge an F-ing B-I-T-C-H, Lohan insisting she will not go to jail and publicly -- I hope you`re sitting down -- compares herself to an Iranian woman sentenced to death by stoning.

UNIDENTIFIED MALE: Stunning developments in the case of actress Lindsay Lohan. TMZ reports Lohan plans to appeal her sentence, even allegedly saying, quote, "I`m not going to jail."
UNIDENTIFIED FEMALE: Between 2007 and today`s date, there have been a number of instances that would show her not taking things seriously.
LOHAN: I respect (INAUDIBLE)
UNIDENTIFIED MALE: Friends of Lohan`s also reportedly told TMZ that just hours after telling the judge she respects her, Lohan was allegedly calling her judge a (EXPLETIVE DELETED) bitch and saying that judge was out to get her.
UNIDENTIFIED FEMALE: She was driving too fast. There was a collision.
LOHAN: I`m not taking this as a joke.
UNIDENTIFIED FEMALE: Then left the scene.
LOHAN: This is my career, and something I`ve worked for my entire life!
UNIDENTIFIED FEMALE: Aside from denying that she was driving, she made a comment at the time, I screwed up. I understand I`m not allowed to drink.
LOHAN: I guess (INAUDIBLE) really all I had to say. I just...
UNIDENTIFIED FEMALE: She was subsequently arrested for driving under the influence again, being under the influence of cocaine and reckless driving.
LOHAN: It wasn`t some sort of a joke.
UNIDENTIFIED FEMALE: She said, I`m sober. I don`t do drugs. And then a urine sample came out positive for cocaine.
LOHAN: And I wasn`t -- you know, I wasn`t missing the classes.
UNIDENTIFIED FEMALE: Her attitude is like somebody who cheats, doesn`t think it`s cheating unless they get caught.

GRACE: Straight out to Carlos Diaz, syndicated radio host and journalist. Not only does she flash those manicured nails specifically that say "F you" at the judge throughout the hearing, like it`s some little inside joke, but now she says publicly the judge is an F-ing B-I- T-C-H?
CARLOS DIAZ, SYNDICATED RADIO HOST & JOURNALIST: Yes. You know, you knew that was going to happen eventually. You knew her disdain. And -- and by the way...
GRACE: What happened to her...
DIAZ: ... Lindsay Lohan...
GRACE: ... telling the judge how much she respects the court? What happened to that?
DIAZ: Well, she`s saying that she respects the court while she has "F you" on both of her middle fingers! How much more disrespect can you have?
GRACE: Hold on.
DIAZ: She is an actress.
GRACE: Carlos...
DIAZ: She`s...
GRACE: Carlos?
DIAZ: Yes?
GRACE: When I was a prosecutor, if somebody even came into court in flip-flops or shorts or inappropriate attire, like a micro-mini or some pimp tricked out, honey, I would send them right back out the door, much less coming in with "F you" written on her nails to flash to the judge?
DIAZ: And the fact that she dismisses it like, you know, it`s just girls having fun shows she`s not taking this seriously at all. And you know, the performance that she gave in court was Oscar-worthy, and then she walks right out of court after she tells the judge she respects her and calls her an "F-ing B." That`s unbelievable! And another thing. Lindsay needs new friends because her friends are leaking all this information to TMZ and other outlets as soon as they can.
GRACE: Let`s take a look at Lohan in court.

LOHAN: I just wanted to take a minute to say that, you know, as far as I knew, I was being in compliant with my program, right (ph) on (ph) programs. You know, when I would ask to leave town, they would give me permission to leave town, so that`s all that I knew that was coming to me.
I wasn`t expecting any special treatment, aside from the understanding that I have to provide for myself. I have to work. And my schedule, you know, unfortunately, is very different. And they were willing to work with me on that. That was the only kind of special treatment that, you know, if anything, they would give me.

Out to Alexis Tereszcuk. We are taking your calls live. Not only does Lohan flash her nails specifically manicured nails to say "F you" to the judge, she now publicly declares, I will not go to jail, and calls the judge an F-ing B-I-T-C-H. Go ahead, Tereszcuk.
ALEXIS TERESZCUK, RADARONLINE.COM: She actually has zero respect for this judge. She -- she knows that she`s a public figure. Everything she says, someone`s going to find out. So she slams the judge with pretty much the worst two things that you can call her. She`s not afraid of anything because she thinks that, honestly, she will get special treatment every single day in every instance. And she has even said, I am not going to jail.
GRACE: To Dr. Bethany Marshall. What is wrong with Lindsay Lohan?
BETHANY MARSHALL, PSYCHOANALYST: This is the classic personality of the addict -- victimization, blaming other people, entitlement, denial, lack of insight into their self-destructive behavior. But the victimization is the most classic sign.
GRACE: You know what, Bethany? You can call it whatever you want to. I think she`s a spoiled brat!

GRACE: Well, right there, to my knowledge, that`s a lie. Alexis Tereszcuk, what children are allowed around Lindsay Lohan?
TERESZCUK: Absolutely right. You know, she went on a trip to Morocco and she was photographed in the center of children. There were a lot of -- there were a lot of controversies when she was there. The government...
GRACE: Wa-wait! She was photographed with some children. Was she working with children?
TERESZCUK: No. My definition of working and your definition of working are probably very different than Lindsay Lohan`s definition of working. Being photographed to me is not working with children. It was another one of Lindsay`s, you know, around-the-world photo ops, where people fly her on private planes to places and she gets VIP treatment. But she really isn`t doing any work.
GRACE: OK, Liz, I want to play my favorite sound. And tonight, I`m not talking about just putting "F you" on her nails. She has gone out and publicly stated that the judge is an F-ing B-I-T-C-H. Let me hear my favorite sound, Liz. Do you have it cued up? Let`s hear it.

Mickey, why is she so surprised? Why the act? And you see her lawyer going, Shut up.
MICKEY SHERMAN, DEFENSE ATTORNEY: I think her lawyer just wants to fall through the crack in the floor. My pain was for the lawyer, I got to tell you. I`ve been there so many times. But you know, she had been in disbelief that they were ever going to really put the gavel down terribly hard on her. And she slipped through. And I go to tell you, I know it`s not the popular view, but I don`t think she should have gotten 90 days. Maybe something, but not 90 days. She didn`t commit any new crimes.
GRACE: Put Sherman up. Put Sherman up. Number one, she said "F you" to the judge on her nails. I`ve thrown people out of court...
SHERMAN: I know.
GRACE: ... for coming in in flip-flops or whatever inappropriate attire, much less to flash that to the judge. But forget about that. That was 48 hours ago. I`m talking about overnight, calling the judge an F-ing B-I-T-C-H, declaring she will not go to jail. Her lawyer has thrown in the towel, Odom! She quit. I wonder why.
PETER ODOM, DEFENSE ATTORNEY: Well, because she had a client that absolutely would not cooperate with her, and that`s been clear from the beginning. This is just a recalcitrant defendant. But I have to say that the word on the street, Nancy, is that 90 days really is too much for this kind of violation. This judge sentences...
GRACE: Oh, really?
PETER ODOM: ... routinely sentences other people...
GRACE: Put him up!
PETER ODOM: ... to 30 days.

GRACE: To you, Eleanor Odom. What about the drugs in her pocket, the nearly running over somebody in that incident where she was DUI and lying to the court over nothing? Why lie over nothing? Why say, I`ve been working with children? That is BS.

GRACE: She should be thrown behind bars on contempt right there!
ELEANOR ODOM: Nancy, I see these cases every day in court, and they get far more than 90 days. Ninety days is a gift to Lindsay Lohan.

UNIDENTIFIED FEMALE: ... you know, the Dilaudid, the Adderall, the Ambien, the Trazadone. My question is, when she goes into the can, the jail, she goes to jail, are these jails equipped medically with her withdrawals? Because she could...
GRACE: Good question!

GRACE: To Brad Lamm. What about Sherry in Illinois`s question?
BRAD LAMM, INTERVENTIONIST (via telephone): Well, and that`s a real problem here. Of course, there`s a medical unit there...
GRACE: Not a problem for me.
LAMM: Well, it`s a problem for me because when somebody goes in with all these crazy narcotics, I think that they should -- I think Lindsay should have an evaluation by somebody that she`s not paying, to evaluate what she really needs to be on. So the answer to your question is, there`s medical unit there, and they`ll hold the medications for her. But literally, she`ll be going into jail and she`ll be on the drugs and staying addicted the entire time she`s there. It`s a shame.

UNIDENTIFIED FEMALE: I wonder what you think about her not getting any -- anything for the first two parole violations. I don`t understand that. And I also don`t understand her dad going on TV at this point and kind of capitalizing on the press here. And the third thing I need to say is I think the attorney`s wrong that was just on. The 90 days is not enough.
GRACE: No. Especially in light, Cindy in California, as you said, of the two prior violations. There`s just been one thing after the next after the next.
And I want to go over very quickly, Cindy in California -- take a listen. And this is from the official probation report that I`ve got in my hand that I`m trying to show right now to -- yes, there you go. Listen to everything that she`s got in her system. Positive for amphetamines. Test results show that there was a ton -- a ton -- a mixture. There`s Adderall. There is the powerful painkiller Dilaudid. She is under prescription for many other drugs, as well.
What about it, Rupa Mikkilineni? What are the drugs?
RUPA MIKKILINENI, NANCY GRACE PRODUCER: Right. She has had -- she has in her -- she has -- they found in her system Adderall, which is a drug used for ADD that was a prescription drug, as well as Dilaudid for a dental surgery that she`d had. And the probation officer says that these were allowed, Nancy.
GRACE: Alexis Tereszcuk, there was not only Nexium, Zoloft, Trazadone, Adderall and Dilaudid. Why wasn`t any of that a violation?
TERESZCUK: She had prescriptions for all of them, which is why it wasn`t a violation. But honestly...

LINDSAY LOHAN, ACTRESS: I always have to take responsibility for my own action. Always.
JUDGE MARSHA REVEL, SUPERIOR COURT JUDGE: You are to attend all scheduled alcohol classes for a period of one week.
UNIDENTIFIED FEMALE: Miss Lohan`s uncle, her mother`s brother, died last week and that was the reason that she missed the session.
REVEL: Did she go to the funeral?
UNIDENTIFIED FEMALE: She did not.
LOHAN: My passport was stolen. So I had no options but to stay there.
REVEL: There is really no valid excuse.
LOHAN: I was there thinking that it was OK that I missed those classes. I don`t see what reason I would go to prison for.
UNIDENTIFIED MALE: She actually ran over my foot. And she didn`t stop. She said, no, I can`t get in trouble. I`m a celebrity. I can do whatever the (EXPLETIVE DELETED) I want.
UNIDENTIFIED REPORTER: The fingernail incident in the courtroom. Was she actually giving the middle finger to the judge.
LOHAN: Enough is enough already.

NANCY GRACE, HOST: With cocaine in her pants, she runs over somebody`s foot and she is yet to do jail time.

DIXIE, CALLER FROM NORTH CAROLINA: Hi, Nancy. You`re terrific. Thank you.
GRACE: I`m not. But thank you for the compliment. What`s your question, dear?
DIXIE: Yes, I want to know since Lindsay Lohan is trashing the judge and insisting she is not going to jail, do you think the judge in the court might consider this serious enough where she think she might be flight risk?
GRACE: Well, I don`t think Lindsay Lohan in her addled state is going to get very far. But the judge did issue -- the court issued a statement saying it was not worthy of comment.
So, you know, I guess judges and prosecutors are used to getting called a host of expletives. But after that shabby performance in court about how much she respected the court and then as the judge called out the sentence the look, the shock on her face after getting away with everything for so very long.
But to you, Eleanor Odom. I want to talk about Adderall just a moment. A lot of people think it is for ADHD, attention deficit. Its nicknames include college crack, cognitive steroid. People take it as a party drug. It contains dextroamphetamine.
It creates a feeling of well being, of confidence, you can go hours on end without sleeping and it`s used for weight loss.
Liz, show me that progression of Lindsay Lohan again. Notice how she gets skinnier and skinnier and skinnier except for her chest that suddenly gets really big but hey, you know what? That`s none of my business.
Take a look at what Adderall can do for you, Eleanor. Look how pretty she is in 2004.
ELEANOR ODOM, PROSECUTOR: You`re exactly right, Nancy. And this is such a common drug of abuse because it`s easy to get. By prescription, you can say you have ADHD. And it`s fairly easy --
GRACE: That looks like a meth shot right there in 2007.
ODOM: It does. And people will actually use this -- misuse it by snorting it instead of taking it by mouth as prescribed. So it`s very abused with addicts.
GRACE: We are taking your calls live. I want to go out to Paul Penzone, VP of prevention programs, Childshelp.org, former sergeant, Phoenix PD.
Paul, weigh in. Why is this case? Look, this isn`t a murder, this isn`t a child molestation, this is an aggravated assault but this is important. Why?
PAUL PENZONE, DIRECT OF PREVENTION PROGRAMS, CHILDHELP.ORG, FMR. SERGEANT, PHOENIX PD: Absolutely. This is making a stand.
You know as a former prosecutor -- and I was a narcotic detective for many years -- we get a front row show to this, the destruction of drugs. And basically there`s only three things that could happen. You get clean, you go to jail or you die.
This judge is Lindsay`s best friend and the rest of the world needs to see how destructive drugs can be. We need to be more aggressive in protecting our children because what`s going to keep her alive, unfortunately, is jail and a serious accountability relative to her lifestyle. Otherwise she is in big trouble.
GRACE: Well, you know, Paul, you are taking a very charitable note on this for her welfare after going through rehabs to the tune of $60,000 per stay.
I`m concerned about the message this sends. The message it sends to everybody across this country. Everybody who cannot afford high-powered lawyer and PR flakes to spin it all for you. And the best manicures and hair extensions and body buffing to make you look great, and acting lessons to sound believable in front of the court.
I`m talking about regular people like us, Paul Penzone. They go before a court and what this judge does with Lindsay Lohan makes everybody else take a bitter pill when they get treated differently.
PENZONE: Well, you`re -- you`re absolutely right because the justice system is as much being judged here as Lindsay is. How they handle this case will resonate to all --
GRACE: Since when did you get on a first name basis?
PENZONE: Excuse me?
GRACE: When did you get on a first name basis?
PENZONE: I apologize.
GRACE: Lindsay Lohan.
PENZONE: When did she get on a first or when did I?
GRACE: Well, you keep referring to her as Lindsay.
PENZONE: I apologize. I don`t know how I can refer to her, but this right here will resonate to all folks at all levels. You`re exactly right.
GRACE: Now wait a minute. Put Penzone back up.
What about reports that she jerry-rigged her SCRAM bracelet by slipping something between the bracelet and her skin so she could booze it up without getting caught? And as the judge accurately pointed out, Penzone, she seemed to believe that Lohan thought she hadn`t gotten in trouble just because she hasn`t been caught.
PENZONE: Well, she`s tried to circumvent the system at every stop. And that in it of itself just shows how much -- what a lack of respect she has for anything that she is accountable to, the routines of the court.
Going in there with her nails painted in the fashion she did, the attitude that she kept, everything about it was nothing less than disrespect for the system. Believing she`s above it all.
We need to be consistent. We need to hold her accountable and send a message that at any level the court system will hold you accountable and that everyone has to pay a price should they violate the law.
GRACE: To Dr. Bethany Marshall, psychoanalyst, author of "Dealbreakers." And yes, Sherman, I know I didn`t mention your book, "How Can You Defend Those People." there. I said it.
OK, back to you, Bethany Marshall. How can she in court talk about respecting the court so much and then walk out the door and say she is an f`ing B-I-T-C-H. I will not go to jail. And then compare herself to an Iranian woman who is set to die by stoning to death.
BETHANY MARSHALL, PSYCHOANALYST, AUTHOR OF "DEALBREAKERS": Well, I think what she did in the court was just outright manipulation. And then as I said earlier, one of the classic signs of an addict is a sense of victimization. She identified with a woman being stoned. That`s the utter sense of victimization.
But I think another thing to note, every addict has a different bottom. We use the term bottom but what is that -- one addict it might be that they have public intoxication or they show up to work late or hungover.
But for another addict it might be that they`re six feet under. And for Lindsay Lohan I keep wondering is that bottom going to be and I hope it`s not too deep.
GRACE: To Ronda in Tennessee, hi, dear. What`s your question?
RONDA, CALLER FROM TENNESSEE: I have a question. I also have a comment.
GRACE: OK.
RONDA: I am a recovering addict of six years, as of July the 4th. I thank my Savior for that. And I love your show.
For Lindsay Lohan, I`m not -- if I had went to court with that on my nails, I would have been stopped for contempt of court then put in jail immediately. I wouldn`t have a week. She don`t need a week. This is girl is (INAUDIBLE). She`s not going to jail. OK, she could kill herself. That`s not fair. She`s not a flight risk. She is a death risk.
(CROSSTALK)
GRACE: You know what, Rhonda, I think you`re right. She`s not a flight risk. She can`t get it together enough to be a flight risk. And -- before I lose you, Rhonda, you know how blessed you are?
RONDA: Yes, I do. And I thank you for that.
GRACE: That you are clean. And I can tell by the way you are talking, have you been in court before?
RONDA: Yes, I have. And --
GRACE: I can tell.
RONDA: You need to do --
GRACE: Because you`re telling it. I want you to tell the viewers right now, Ronda, what would happen if you walked to the courtroom with "F You" written on your fingernails. What do you think that bailiff or that sheriff would do with you?
RONDA: I would be in contempt of court. I would get locked up immediately.
GRACE: What about it, Mickey Sherman? She might as well have taken an ad on Broadway.
MICKEY SHERMAN, CRIMINAL DEFENSE ATTORNEY, AUTHOR OF "HOW CAN YOU DEFEND THOSE PEOPLE?": Well, every judge has their own level of what they`ll bear in court. But, you know, wouldn`t you agree that the drugs and the alcohol are symptoms. They`re not the real problem. This is a screwed up kid. Was a movie star when she was very young.
(CROSSTALK)
GRACE: She is not a kid. She is 24 years old.
SHERMAN: No, to me, that`s a kid. But the bottom line is that she has not been convicted of any new crimes. All she had is a crappy attitude. And certainly the nails don`t help.
And also, I know you`re going to love this, but isn`t it possible now the first judge may have to disqualify herself? Even though it`s self- created, but the fact she has now been labeled an f`ing bitch in the media --
GRACE: Hey, hey, hey! Just because she talked like that, no need for you to chime in, Sherman.
SHERMAN: Sorry.
GRACE: To Dr. Jennifer Shu, what can Adderall do to you if snorted?
DR. JENNIFER SHU, PEDIATRICIAN, CO-AUTHOR OF "HEADING HOME W/YOUR NEWBORN": Well, you expected heightened effects of the drug. So when a person with ADHD it really helps you focus.

UNIDENTIFIED REPORTER: These are the words of Kaine Horman, little Kyron`s dad. He writes in the restraining order, "I believe Terri Horman is involved in the disappearance of my son Kyron. I also recently learned that she attempted to hire someone to murder me."
UNIDENTIFIED MALE: Since her last statement requesting that she cooperate with investigators, she has not contacted investigators and provided any information to assist and bring Kyron home.
UNIDENTIFIED REPORTER: They believe that Terri Horman has these answers.
UNIDENTIFIED REPORTER: A short time ago the judge unsealed a restraining order against that mom.
JEAN CASAREZ, CORRESPONDENT, "IN SESSION": Just when you think it can`t get any worse.
UNIDENTIFIED REPORTER: The case surrounding missing 7-year-old Kyron Horman takes a shocking term.
UNIDENTIFIED REPORTER: The father says he believes his wife is involved in the disappearance of his 7-year-old son.

GRACE: We are just coming out of a live press conference.
Out to Natisha Lance standing by on the scene with the family in Beaverton, Oregon.
Natisha, what did you learn?
NATISHA LANCE, NANCY GRACE PRODUCER: Well, Nancy, Big news coming out of Oregon today.
First of all the judge unsealed a restraining order that was filed by Kaine Horman just 11 days ago. Now in this order, Nancy, we learned now that Kaine Horman said based on probable told to him by police that he believes not only is Terri Horman involved in his child`s disappearance but also that she attempted to hire a hit-man to kill him.
Now in this press conference, Desiree Young, the mother of Kyron Horman also says that she Terri Horman is lying. She`s known her for a long time. And in addition to that, all of the family has taken polygraph tests.
In that polygraph test, Terri Horman is the only one who was asked to take two and according to Desiree Young she failed both of them.
GRACE: So we are just starting, everybody. Live in Beaverton, Oregon, I`m talking about the disappearance of a 7-year-old little boy Kyron. The mother, the stepmother fails the polygraph.
The biological mother saying she had an instinct from the very beginning moments she got into the car with the stepmother that she was lying.
What else do you know, Natisha Lance?
LANCE: Well, just as you said, Nancy, that she had an instinct from the very beginning. They also asked during this press conference if there was any indication in the past, if there was some trouble at home. They said no. They were completely blindsided by this whole thing.
They are still waiting for Terri Horman to cooperate. But she continues to lie. Now her attorney was at the courthouse today. He was not giving any comment whatsoever.
Terri Horman has been locked away in her home. And also Kaine Horman had amended his petition to move back into the home. So that means that Terri Horman would have to move out based on that restraining order that is now in place.
GRACE: To Matt Zarrell, our producer on the story. The restraining order. We have gotten our hands on the affidavits and the evidence supporting that emergency restraining order. What do we learn?
MATT ZARRELL, NANCY GRACE STAFFER, COVERING STORY: Yes, I`ve got it right here, Nancy.
She is ordered to stay at least 500 feet away from not only Kaine Horman but 19-month-old Kiara. She`s also not allowed to have firearms. And Kaine Horman makes it clear in the restraining order he is concerned about her getting access to firearms because she allegedly tried to have him killed.
GRACE: Matt Zarrell, I want to talk just a moment about her hiring, or trying to hire a hit-man to murder her husband.
This is Kyron`s father, just before Kyron disappeared, what are the allegations?
ZARRELL: OK, now, multiple sources have told CNN affiliates that a landscaper -- that Terri Horman approached a landscaper several months ago, and wanted to set up a hit on her husband.
Now apparently Police were going around recently interviewing everyone that was connected to Terri Horman. They interviewed this landscaper. This landscaper reveals this information.
Now on June 26th, just a couple of days ago, they wire up the landscaper. The landscaper goes to Terri Horman`s house who`s an undercover cop and allegedly tells Terri Horman I want $10,000 to kill your husband or I`m going to the police?
Well, Terri Horman immediately cuts off the conversation. Sources say that Terri Horman would have been arrested had she implicated herself in this taped conversation, Nancy.
GRACE: I want to go to C.W. Jensen, retired Portland police captain, joining us there in Beaverton on the scene with the family.
Sir, thank you for being with us. Mr. Jensen, the restraining order, we`ve read it and it clearly lays out that police have told the father, the biological father, that there is reason to connect Horman with Kyron`s disappearance.
On top of that, she tries, according to the documents, to have her husband murdered. Why hasn`t she been arrested?
CW JENSEN, RETIRED PORTLAND POLICE CAPTAIN: Miss Grace, one of the things I learned when I was a homicide detective was, you know, there are certain cases that you have to make an arrest very quickly, when you think that the community is in danger, that the person may reoffend.
In this case they`ve all along known that she is the suspect. She always has been. And they knew where she was. The daughter and the father are now gone. She`s not going to reoffend.
They, I think, have probable cause to arrest her for kidnapping. I think they have probably cause to arrest her for the disappearance. I think what they are waiting for is to get probable cause to arrest her for homicide.
GRACE: C.W. Jensen, joining us from Beaverton, retired Portland police captain, you could not have said it more succinctly. Because if you give somebody enough rope they`ll hang themselves, right?
So how do I know they don`t have her phones tapped, her cell phone tapped, her home tapped. For all I know they are listening in on everything she is doing. And they are watching her.
Tell me why you say she is a suspect from the get-go?
JENSEN: Well, there are certain things. I mean I have investigated cases where strangers abducted and killed children. In this case, you know, that is very, very rare to have a stranger/stranger abduction.
This school is -- Miss Grace, in the middle of nowhere. Very tight knit. You know, so that to me immediately -- the odds of that were very rare. This kid went to this school every single day of the entire year.
Did I think that he left the last week of school when he was excited to be there? Absolutely not. So what are we left with? A family member, a friend. The mother was the last one to see him.
I used to take my daughter to school. If she was 15 feet from the door no one was going to take her. I never believed it from the beginning. And I don`t believe it now.
GRACE: I want to go -- everybody, let me remind you that Terri Horman, the stepmother, is not a suspect. She has not been named a suspect by police.
I want to go to Marc Klaas, president and founder of KlaasKids Foundation.
Marc, what`s your take?
MARC KLAAS, PRESIDENT AND FOUNDER, KLAASKIDS FOUNDATION: Well, I think that there`s one third possibility that that exists, and that would be somebody hiding in plain sight. In other words, a janitor or a secretary, a teacher or a teacher`s helper that`s always at the school anyway. Although I think that`s as remote as the stranger scenario of just about.
My take is pretty simple. She seems to be suffering what you could almost call Peterson syndrome. It`s a situation where seemingly normal people, people that don`t have any kind of a criminal record, decide to disappear or erase their family members instead of walking away from them.
GRACE: Everyone, you are seeing shots of 7-year-old Kyron Horman, 3`8", 50 pounds, brown hair, blue eyes wearing black t-shirt with CSI on it, black cargo pants. Take a look.
Back to you, C.W. Jensen. You stated that Terri Horman has antifreeze in her blood. Why?
JENSEN: That`s because -- I mean, think about it. She`s -- and Miss Grace, you know, as a prosecutor, if I`m a detective, I don`t have to tell anybody that they`re a suspect. And so they weren`t going to do that from the beginning. And so she`s been the suspect, always will be.
GRACE: -- break, I want to wish a happy birthday from the heart to tiny crime fighter Will Sikoli. Celebrating birthday number 2. He loves playing with his older brother Luke, new baby brother Matthew Dean, time with mommy and daddy.

GRACE: In a presser that just went down, we were live on the scene. We learn that stepmom Terri Horman, the last one to see 7-year-old Kyron alive, flunked polygraphs.

EMMY, CALLER FROM VIRGINIA: Hi, Nancy. I love your show but I just want to know how can this woman lose a 7-year-old child? It`s not like you`re super small, it`s not like you`re a puppy.
How do you lose a 7-year-old? And then later in the day lie about where you are? Do you think that that`s giving you any credibility? Like --
GRACE: You know that`s a great question. Bethany Marshall -- Dr. Bethany, did she think we wouldn`t know once this became -- a criminal investigation?
MARSHALL: You know, Nancy, because you`re a prosecutor, these criminals think like third graders. They have such shallow, shabby attempts to cover up their crimes. And I suspect that there was a financial incentive somewhere, maybe the biodad with the life insurance policy.
GRACE: Yes. Following on the heels of an alleged attempt to hire a hit-man.
