Juror Dismissed in Jodi Arias Trial
Aired April 02, 2013 - 20:00 ET
THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.
(BEGIN VIDEO CLIP)
UNIDENTIFIED FEMALE: So in that e-mail, did that prompt a response, then, from Chris Hughes individually and then another e-mail from Sky Hughes individually?
ALYCE LAVIOLETTE, DOMESTIC VIOLENCE EXPERT: Yes.
UNIDENTIFIED FEMALE: All right. Can we talk about those, then, for a second?
LAVIOLETTE: Sure.
UNIDENTIFIED FEMALE: All right. And I guess specific with Chris Hughes, when he responds, does he-- based on your review of his response, what is your impression of that conversation?
LAVIOLETTE: That he is basically telling Ms.-- Mr. Alexander--
UNIDENTIFIED MALE: Objection, hearsay.
UNIDENTIFIED FEMALE: Overruled.
LAVIOLETTE: That he is suggesting to Mr. Alexander that he has reason to believe that he mistreats Ms. Arias, that he is a flirt, that he has a history of not being particularly good with women, that he`s a flirt, that he`s the biggest flirt this side of the Mississippi, that--
(END VIDEO CLIP)
NANCY GRACE, HOST: He`s a flirt. So he got the death penalty!
Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight. After slashing and shooting lover Travis Alexander to death, leaving his body in a dripping-wet shower stall, Jodi Arias`s defense team still fighting to recover from the disaster of the first shrink, Dick Samuels.
In the last hours, juror number five booted off the jury, Arias demanding the judge throw out the case entirely by mistrial. Now, back in the courtroom, are we down to the final witness for the defense? And is this witness actually swaying the jury to acquit Jodi Arias?
And tonight, we obtain for you exclusive video and photos from Travis`s funeral, the funeral where Arias was a no-show, claiming she had a flat tire. This is the woman who drove all the way across the desert to murder Travis, but suddenly to get across town, she has a flat tire.
Tonight, we`re examining the evidence that Arias lied and was actually afraid to attend Travis`s funeral because others would see that it was all just a charade, a deadly charade.
Take a look at the video we are showing you right now. Let`s see it in full, please, Liz. You are seeing shots there at Travis`s funeral. Look around very carefully. Obviously, Jodi Arias not attending. Now, remember, the funeral took place several days before the memorial. After not attending this funeral, Jodi Arias thought better of it and then attended the memorial.
Right now, you are not missing one word of testimony. We`re taking you straight back into that courtroom. But as we wait to go back into the courtroom, Jean Casarez, legal correspondent, joining me right out in front of the courthouse. Everybody, we are live and camped out at the Arizona courthouse to bring you the latest in the Arias murder one trial.
Jean, juror number five, a lady juror, thrown off the jury. She`s out of there. Any idea what it was she said to the other jurors that got her off the jury?
JEAN CASAREZ, ``IN SESSION``: We don`t know. All we can go by is the defense motion, which is really talking about that if any jurors are spoken to or tampered with or have discussions in any way, that action must be taken. We don`t know what she said. But Nancy, it is so different when I look at the jury and she`s not there. That was the juror that I kept focusing on.
GRACE: Yeah. Jean, I remember her crystal clear. You couldn`t see her and not remember her. She had a very identifiable hairstyle. It changed colors a couple of times during the trial. It reminded me of the woman I dubbed ``strawberry shortcake`` in the Scott Peterson trial.
For those of you that are just joining us, you`re not missing any live testimony. We`re taking you right back into the courtroom as soon as we`re going to resume that testimony.
Jean, it could have been something as simple as, I don`t believe a word Arias says. It could have been that simple. We know it was anti- Arias because the defense is the one that wanted her thrown off the jury, not the state.
CASAREZ: Nancy, they were in there for two hours. And I`m sitting in the courtroom, and finally, the Travis Alexander sisters come out. They look like they`re going to cry. And then Kirk Nurmi comes out for the defense, Jodi Arias comes out through the door, they had big smiles on their face, so I saw exactly what had happened.
GRACE: You know, this is so hard on the family to be put through the wringer like this.
Everyone, tonight, we have obtained special footage, photos from Travis`s funeral. And the importance of this is, look at the people that are at the funeral, notably Jodi Arias not there. This is the man she loved. This is the man she wanted to marry. She doesn`t show up at the funeral.
Why? Many people believe that it was because Jodi Arias didn`t think she could pull it off, that even for Arias, it would be too much of a lie to go to this funeral and grieve, that people would see through her deadly charade.
Joining me right now is Aaron Dewey, friend, roommate of Travis`s. He spoke to Arias the morning of Travis`s funeral. Her story was that she had a flat tire and couldn`t come to Travis`s funeral. What a bucket of hogwash that is.
To Aaron Dewey, you attended the funeral. Why did Arias not attend?
AARON DEWEY, FRIEND OF TRAVIS ALEXANDER (via telephone): Well, Nancy, as you said, she called me supposedly about halfway down the California coast early on on the morning of the funeral. She had said that she had left work late the night before and was going to drive through the night to get down to southern California the morning of the funeral.
She called and said that she had gotten a flat tire on the way down, that the spare in her car was also flat, and she had to wait for a tire store to open in the area where she was, somewhere in the middle of the state, so that she could get her car fixed and get back on the road for the funeral.
GRACE: So Aaron, you`re telling me that this is the woman who thought to stockpile gasoline in big jugs in her trunk when she went on the trip, but that she had a flat tire and her spare tire was flat?
DEWEY: Yeah. It doesn`t really add up.
GRACE: No, it doesn`t. Now, let me ask you another question while I`ve got you on the phone. The Hugheses`, friends of Travis Alexander`s, e-mails have come under fire in the last hours in court. And it could be deadly to the state`s case, e-mails that, according to the defense-- I don`t know if this is true or not-- suggest Travis was abusive.
Now, isn`t it true that Arias discussed her sex life with you, her sex life with Travis, and never once did she state that it was anything but consensual?
DEWEY: That is correct.
GRACE: What did she tell you?
DEWEY: She told me-- when she was here in Arizona for the memorial service, that she actually did attend-- one of the nights that she was here, we were kind of having a heart-to-heart and she told me that she and Travis had had a long-standing sexual relationship, that it had started while they were dating and that it had continued even after they broke up and had started seeing other people.
But at no point did she indicate that she was not interested in continuing that, and at no point did she indicate that she was being forced by Travis into that type of relationship.
GRACE: What do you think of the testimony today regarding those e- mails by Chris and Sky Hughes, which call Travis abusive, according to the defense?
DEWEY: I think-- just like we`ve seen from the defense over and over in this case, my belief is those e-mails are being taken completely out of context. You know, Mr. Martinez has done a very good job at keeping the entire transcript of the e-mails suppressed, so we may never know exactly what was said.
But we do know that it`s a string of e-mails back and forth between Travis and the Hugheses. And I think the conversation that`s being referenced is probably saying something very different than what the defense is trying to create it to say.
GRACE: With me is Aaron Dewey, a friend and roommate of Travis Alexander`s, also knew Arias. You believe her behavior at the memorial, which was several days after the funeral, was bizarre. Explain.
DEWEY: She actually sat right next to me at the memorial service. She sat there quite quietly during the actual service itself, kept her head bowed, didn`t really make eye contact with anyone, didn`t shed a tear. Not once did she shed a tear, like we`ve seen her do over and over in court.
After the service was over and people were, you know, around mingling and sharing their thoughts, she was back to her normal, bubbly self. She was saying hi to people that she hadn`t seen since she`d moved away. She was catching up with supposed old friends. While the rest of us were trying to hold back the tears and keep our composure, she was bouncing around, visiting people like this was some type of a social event.
GRACE: OK. That is bizarre. Liz, would you play the video we have just obtained of Travis`s funeral? Let`s see that video.
Now, as you are looking at this family grieving, distraught, can you imagine Jodi Arias`s face in this crowd?
(COMMERCIAL BREAK)
(BEGIN VIDEO CLIP)
UNIDENTIFIED MALE: All these people are here for me?
JODI ARIAS, CHARGED WITH MURDER: I didn`t go to his funeral. I tried to go, and I didn`t make it.
UNIDENTIFIED MALE: She said that she didn`t go. She said that she had caught a flat just outside of Fresno somewhere in central California.
UNIDENTIFIED MALE: She was tearful, and she was painting the picture of a friend in mourning.
ARIAS: I thought if I didn`t show up, it would look suspicious because Travis and I were close.
UNIDENTIFIED MALE: Nothing out of the ordinary, nothing unusual for me at the time. But looking back, knowing what she`s done now, it`s pretty creepy.
UNIDENTIFIED MALE: She came up to me and gave me a big hug and just said, you know, Isn`t this just horrible? I`m so sorry you had to go through that. Nonchalantly, just, How is everything?
UNIDENTIFIED MALE: She didn`t cry. She didn`t laugh. She didn`t break a smile. She didn`t shed a tear.
UNIDENTIFIED FEMALE: She came up to me and introduced herself. And she introduced herself as Jodi Arias.
UNIDENTIFIED MALE: Very aloof, very distant.
UNIDENTIFIED MALE: She seemed like she was trying to act sad, like the rest of us.
(END VIDEO CLIP)
GRACE: Welcome back, everybody. We are live and camped outside the Arizona courthouse. You are just seeing exclusive video that we obtained of Travis`s funeral, showing Arias was a no-show. Now, her story that she had a flat tire en route completely under fire and believed to be yet another mammoth lie by Jodi Arias. She didn`t go to that funeral because she was convinced she couldn`t pull it off, that others would see through her deadly charade.
But right now, we`re heading straight into the courtroom.
UNIDENTIFIED FEMALE: All right, let me ask you about Ms. Arias, though. Did she-- based on your conversations with her, did she ever feel like she could go and date other people or certainly have a full-on relationship with another man while she`s in this quasi-relationship with Mr. Alexander?
LAVIOLETTE: No, she didn`t.
UNIDENTIFIED FEMALE: OK. So the deception you see is from the fact that-- with regard to Ms. Andrews?
LAVIOLETTE: I see deception in a lot of areas, that there`s deception about being a virgin, so there`s a belief in the community that he`s a virgin. Ms. Andrews is part of that community. There`s a belief in the community that he`s a virgin, and he perpetuates that belief.
There`s a belief that he`s financially successful, and he perpetuates that belief. And there`s not a lot of evidence to say that he is. He`s deceptive about what he`s done sexually. So there`s deception about who he is. There`s a deception about relationships with other women. So where he`s e-mailing--
UNIDENTIFIED MALE: Objection, foundation.
UNIDENTIFIED FEMALE: Sustained.
UNIDENTIFIED FEMALE: Did you review other text messages and e-mails from other women and Mr. Alexander?
LAVIOLETTE: Yes, I did.
UNIDENTIFIED FEMALE: OK. So based on those, what is it that you see?
UNIDENTIFIED MALE: Objection (INAUDIBLE) hearsay.
UNIDENTIFIED FEMALE: Approach, please.
GRACE: You know, when I first pegged LaViolette as likable to this jury? Well, that is eroding quickly. What has this degenerated to? He wasn`t a virgin? Hello? He was in his 30s! He wasn`t as financially successful as he projected? Wow! You could just accuse everybody on 5th Avenue and Madison of that, and it would all be true. So that`s the proof the defense has, that he`s not a virgin? Are you kidding me? I can`t believe this is being brought into a murder one trial!
UNIDENTIFIED FEMALE: With regard to deceiving other women, do you have specific-- do you know who these women are? The names, I mean.
LAVIOLETTE: I know the names of many of the women.
UNIDENTIFIED FEMALE: OK. Go ahead. Tell me what they are.
GRACE: How much more do we have to hear about Travis Alexander seeing other women? He didn`t make a secret about it! Who cares?
UNIDENTIFIED FEMALE: Shaytonya (ph)?
LAVIOLETTE: Shaytonya, Maria, I believe probably Deanna (ph), Jodi, Lisa--
UNIDENTIFIED FEMALE: All right. And this e-mail that we just went through, Matilda (ph)?
LAVIOLETTE: Matilda.
UNIDENTIFIED FEMALE: OK. Based on-- so there`s-- are there conversations going on with all of these women at some point?
LAVIOLETTE: Yes, there are. And Krista (ph) is another one.
UNIDENTIFIED FEMALE: OK. And when you talk about deception, are you- - what do you mean?
LAVIOLETTE: I mean that it doesn`t appear that these women are aware of each other, so that he is able to lead a life of deception and somehow reconcile that with his own faith and his own behavior, that he is somehow able to pull that together and compartmentalize his life.
GRACE: Unleash the lawyers, Jeff Gold, defense attorney, in the courtroom today, joining us outside the courthouse, Kirby Clements, defense attorney, Atlanta. Also with me, psychologist Dr. Caryn Stark.
Kirby Clements, you`re kidding me! The big drama is that he dated different women? I guess I could convict both of you of that at some point in your life. I mean, really? Are you serious? That`s the defense?
KIRBY CLEMENTS, DEFENSE ATTORNEY: Well, no, I think that the defense is trying to--
GRACE: Deanna, Krystal--
CLEMENTS: --lay the foundation--
(CROSSTALK)
CLEMENTS: They got to lay the foundation to show that this man is not the angel that you would have him to be, as well.
GRACE: So? So?
CLEMENTS: That is important and go to the defense--
GRACE: Really?
CLEMENTS: --that he was an abusive man, that he abuses women--
GRACE: That he dated different women.
CLEMENTS: --he emotionally-- that he deceived them.
GRACE: He was very open.
CLEMENTS: He was emotionally manipulative. But you know what? It all goes to show you--
GRACE: Whew! That stinks! Oh, that stinks.
CLEMENTS: It makes-- you don`t like the smell--
GRACE: Jeff Gold, help me out.
CLEMENTS: --but it helps-- it`s the truth.
GRACE: Please help me. It`s the truth, but it is irrelevant!
CLEMENTS: Well, look, the thing of it is--
GRACE: She`s a psycho freak that chases down all of the women her boyfriends are dating and confronts them in the bathrooms, in ladies rooms, in the library, wherever-- I mean, that doesn`t matter in this case. Of course he`s dating different women!
CLEMENTS: Nancy--
GRACE: I mean, come on, Jeff Gold. When Jodi Arias would walk into a room, she`d say, Hi, I`m Travis`s girlfriend, in front of everybody, and say, No, she`s not. It was no secret he was dating other people.
JEFF GOLD, DEFENSE ATTORNEY: Look, there`s things to say. I mean, I`ve said this before, that they`re making a mountain out of a molehill. On that I agree with you. But there was 11 days of testimony that I think was believable about Jodi, about her being used for sex. If the defense would have done that and continued on that and made a second-degree case, not this domestic violence case, but taken that and woven that into what really happened, which is she flipped out and killed him, they might have a defense.
GRACE: OK. You know what? Jeff, you actually had an ounce of truth in that. I`m very impressed. Kirby, you could take a lesson.
Caryn Stark, come on. Look at the two men talking on the screen right now, the two defense attorneys. You think one of them or both have never dated more than one woman at once prior to their very happy marriages? Come on, please! I just find this so off-putting. I bet that jury is about to roll over if they hear Travis wasn`t a virgin one more time.
CARYN STARK, PSYCHOLOGIST1: You know, Nancy, I really hope that you`re right because it`s just so ridiculous that they are focusing on these little facts and trying so hard to make him be the problem, when she`s a psychopath.
(COMMERCIAL BREAK)
(BEGIN VIDEO CLIP)
LAVIOLETTE: Two very separate experiences, one that makes her sick and one that he makes her happy.
ARIAS: He had aspects of himself that were beautiful and were ugly (INAUDIBLE)
(END VIDEO CLIP)
GRACE: Everybody, because of the time difference, there is still testimony. Let`s go into the courtroom, Liz.
LAVIOLETTE: He is somehow able to pull that together and compartmentalize his life so that he can have these relationships with all these different women.
UNIDENTIFIED MALE: Objection, foundation. As to relationship.
UNIDENTIFIED FEMALE: Sustained.
UNIDENTIFIED FEMALE: All right. Well, we`ll get to some of those text messages a little bit later. Let`s talk about September 27th, and this is just a journal entry on September 27th from Ms. Arias. And she writes a gratitude list. Did you see those in her journal entries?
LAVIOLETTE: Yes, I did.
UNIDENTIFIED FEMALE: And (INAUDIBLE) this is exhibit (INAUDIBLE) marked as 574 (ph). But about journal-- about her journal entries, did you see where she writes these gratitude lists?
LAVIOLETTE: Yes, I did.
UNIDENTIFIED FEMALE: And what is--
(COMMERCIAL BREAK)
(BEGIN VIDEO CLIP)
UNIDENTIFIED MALE: I assume she was going to the funeral. She didn`t go. She said that she had caught a flat.
ARIAS: Maybe just a little deflated. I have a poor sense of direction. I got totally lost.
UNIDENTIFIED MALE: She said she got lost. She got on the wrong freeway, and she was kind of airheaded like that. That`s what she said.
ARIAS: Been kind of in a daze. I honestly got lost. It`s bad timing. At one point, I wasn`t going anywhere because I ran out of gas. I had fallen asleep.
UNIDENTIFIED MALE: She, you know, was so tired, she fell asleep.
ARIAS: Still half asleep. I don`t know.
(END VIDEO CLIP)
GRACE: The testimony that she gave regarding the memorial and the funeral -- we have obtained exclusive video of Travis` funeral. Can you imagine if Jodi Arias` face had appeared in this grieving crowd of friends and family? But now her explanation that she had a, quote, flat tire is under fire, because it seems that a woman who rode across the desert in order to murder Travis Alexander, stockpiling gasoline cans and provisions, would have a spare tire that wasn`t flat. Was she afraid that she would be suspected of murder?
We are live and taking your calls. But right now straight in for more testimony.
UNIDENTIFIED FEMALE: And what is it -- what were those about?
UNIDENTIFIED FEMALE: She was writing about five things she was grateful for. She decided to do that as a way to make herself feel better, to start the day --
UNIDENTIFIED FEMALE: Objection. Speculation.
UNIDENTIFIED FEMALE: Overruled.
UNIDENTIFIED FEMALE: And her No. 1 -- the No. 1 item on her gratitude list was Mr. Alexander.
UNIDENTIFIED FEMALE: Objection. (inaudible).
UNIDENTIFIED FEMALE: Sustained.
UNIDENTIFIED FEMALE: All right. With regard to this journal entry, does she make a gratitude list?
UNIDENTIFIED FEMALE: Yes, she does.
UNIDENTIFIED FEMALE: And when she`s talking about gratitude, she`s being thankful for what she has in her life, is that right?
UNIDENTIFIED FEMALE: Yes, she is.
UNIDENTIFIED FEMALE: All right. And does she put Travis Alexander on this list?
UNIDENTIFIED FEMALE: Yes, she does.
UNIDENTIFIED FEMALE: And where?
UNIDENTIFIED FEMALE: Objection, hearsay.
UNIDENTIFIED FEMALE: Overruled.
UNIDENTIFIED FEMALE: No. 1.
UNIDENTIFIED FEMALE: All right. Does that speak to you what she was feeling about him at that time?
UNIDENTIFIED FEMALE: Certainly.
UNIDENTIFIED FEMALE: OK.
UNIDENTIFIED FEMALE: She`s most grateful for him.
UNIDENTIFIED FEMALE: All right. And so are you seeing -- are you seeing where she`s having, like, loving feelings towards him?
UNIDENTIFIED FEMALE: She`s most grateful for him, so if I go a step further, I would say that it`s because of loving feelings.
UNIDENTIFIED FEMALE: OK. So when we`re talking about their relationship in September of 2007, and I know we talked about this horrible fight in Havasu (ph) and things like that -- ultimately, though, is she still -- is she still having this struggle where there are some good days where she keeps hoping for, and then bad days?
UNIDENTIFIED FEMALE: Yes. There are absolutely good days and bad days.
UNIDENTIFIED FEMALE: OK. And is that important to you?
UNIDENTIFIED FEMALE: It`s important to me in that when somebody is looking at the good days and the bad days, until they get to a place where the bad days weigh more, even if they`re about equal, the good days weigh more. And so you kind of put in perspective what you`ve got, and this perspective is, you know, there`s more good than bad in this relationship. And when we feel connected, I feel very connected. And so, you know, I`m still there.
UNIDENTIFIED FEMALE: OK. As part of your review of this case, did you review e-mails between Mr. Alexander and a person named Deanna Reed (ph)?
UNIDENTIFIED FEMALE: Yes, I did.
UNIDENTIFIED FEMALE: And were there ever any e-mails you reviewed where Ms. Reed was asking him to pay her back?
UNIDENTIFIED FEMALE: Objection.
UNIDENTIFIED FEMALE: Approach.
UNIDENTIFIED FEMALE: Five-minute recess. Please go back to the jury room. We`ll call you back shortly.
GRACE: Everyone, we are taking your calls live. Out to Lynn in Wisconsin. Hi, Lynn. What`s your question?
CALLER: Hi, Nancy. Thanks for taking my call. I just love you.
GRACE: Thank you.
CALLER: My heart breaks every day for Travis` family. But what I wanted to say is a lot of the behavior that they`re describing, the way that Travis acted to Jodi or treated her, could have a lot to do with -- I mean, can you imagine having this psycho girlfriend that just won`t stop?
GRACE: You know, you`re right, and I imagine at some point he probably got downright mean after he kept trying to tell her he wanted to break up. He wanted to go out with other women. And it just seemed to get worse and worse and worse.
Today, the whole trial in jeopardy after the defense moves for a mistrial and accuses juror No. 5 of misconduct. And joining me tonight is the man that knows the drill very well. It`s Mike Belmessieri, Scott Peterson juror and co-author of "We the Jury: Deciding the Fate of Scott Peterson." Mike, it`s great to have you with us. Long time, no see, friend.
MIKE BELMESSIERI, FORMER JUROR, SCOTT PETERSON TRIAL: Hello, Nancy. How are you?
GRACE: I`m great. So what did you think when you heard -- of course, brings up juror No. 5, I think that was Justin Falconeri (ph) or Justin Falconier (ph).
BELMESSIERI: Falconer.
GRACE: Yes, yes, him. Ironically, also juror No. 5. But what do you make of what happened today, Mike?
BELMESSIERI: You know, things like this will happen, especially in a long trial. We had three jurors dismissed during -- well, actually two dismissed. I`m not quite sure what happened to our foreman, if he really wanted off or if he was dismissed. But during the -- during Peterson, we lost three jurors. Two in deliberations, and then early on, we had Justin.
So, you know, I guess that what happens is sometimes people just can`t keep to themselves about what they think. And they ignore the admonishments of the courts. And, you know, we were instructed at least once a day to not discuss the case. Do not -- you`re not allowed to talk about it unless you`re in a deliberation room with all the other jurors. And after that, it`s on to something else. Talk about football, baseball, whatever. Not the trial.
GRACE: You`re right. It`s not really that hard. You get, like, a few very simple rules. Now, I do not believe that this juror No. 5 wanted to be thrown off. I think she wanted to be on the jury. Clearly, the defense wanted her off. So whatever comments she made had to be anti- Arias.
BELMESSIERI: Well, you know, Nancy, I think that, you know, at this point in the trial, the defense is probably not feeling very confident in their case. And maybe they might want to move forward and try to get a mistrial. Much like some of what we saw in Peterson, in respect to movement for a mistrial. We saw that happen on a couple of occasions.
You know, this attorney is fighting for his client`s life. We`re not talking about a traffic ticket. We`re not talking about shoplifting. We`re not talking about a burglary. This is a capital case. And he doesn`t want it to get -- or the attorney doesn`t want it to get to the point to where that jury is going to have a decision, innocent or guilt, death or life.
GRACE: Frankly, though, everybody, with me Mike Belmessieri from the Scott Peterson trial. I wonder, though, if the jury will hold it against the defense that No. 5 was thrown off. With me, Jean Casarez right there at the courthouse. I don`t think five wanted to be thrown off, Jean.
CASAREZ: No. And what we`re understanding is that when she came out of the front door of the courthouse, escorted by security, that she had tears streaming down her face.
GRACE: Oh.
CASAREZ: She wanted to stay on that jury.
(COMMERCIAL BREAK)
(BEGIN VIDEO CLIP)
UNIDENTIFIED FEMALE: What`s the importance of the e-mail?
UNIDENTIFIED FEMALE: That Mr. Alexander has been abusive to women. Information about his prior treatment of other women.
UNIDENTIFIED FEMALE: Mr. Alexander`s closest friends thought that he had issues with women.
UNIDENTIFIED FEMALE: Yes, there is. There`s reason to believe that he mistreats Ms. Arias.
He treated her badly, but he didn`t feel badly about having treated her badly. About his childhood, that they think has greatly affected him in relationship to women.
Alexander calling Ms. Arias a skank, and then acting like it was a joke. The way he ignored her in public places. His manipulation of that woman. Her fear of telling him anything that she has a problem with because he may reject her. Asked Ms. Arias to move on from the relationship. He`s the biggest flirt this side of the Mississippi.
(END VIDEO CLIP)
GRACE: He`s a flirt. So what, he gets the death penalty? Jean Casarez, did I understand correctly that Jodi Arias was spotted smiling today?
CASAREZ: Well, I saw her smiling when she came out of the door where the judge`s chambers after juror No. 5 was excused. But she`s very happy with this witness. She seems to be very engaged, and I think she thinks she`s great compared to Dr. Samuels.
GRACE: Yes. You`re right about that, Jean. I`ve noticed the very same thing that you`ve identified. She seems very happy with LaViolette.
I`m going to follow up on what Jean has just accurately observed in the courtroom. Susan Constantine, jury consultant, body language expert. You know, that takes a nerve to come out after you get juror No. 5 thrown off, who leaves the courthouse in tears, a fine woman to my understanding who did not want to be thrown off the jury, and Arias comes out smiling like the cat that swallowed the canary?
SUSAN CONSTANTINE, JURY CONSULTANT: Yes, exactly. She really felt good about it. The fact that you saw the smile was telling you inside what she was feeling about that juror, that connection that she had with him. She probably knew that she would not really be a very good defense juror for her, so the fact that she was kicked off really made her very, very happy, because she was probably more pro-prosecution than she was a defense juror.
GRACE: She very rarely lets loose with a full-blown smile in front of the jury. She tries to look serious and concerned. But she just couldn`t hide it today, Caryn Stark. She was so happy to get five thrown off.
STARK: Well, Nancy, because it has nothing to do with him. It has everything to do with the fact that she wants to get off. She doesn`t have genuine feelings. She`s not capable of them. So she doesn`t even know to hide the fact that she`s happy.
GRACE: And you know what really struck me, Caryn? I was watching that video, the funeral footage that we obtained. It was very difficult to obtain, and we got it because I think Arias can be busted on her big, fat lie about why she didn`t come to the funeral. But it struck me as I was watching all these people in grief, in torment over someone they loved being slashed to death like this, what if I saw Arias` face in the midst of this? It would just -- it would just -- it would be so wrong, Caryn.
STARK: Well, Nancy, it was wrong that she was even at the memorial. But I have to tell you, if she was at this funeral, you would have seen that fake, can`t cry, you know, looking as though she cares, but she doesn`t really. You would see right through her.
GRACE: Just the way Aaron Dewey (ph) describes it. OK, I`m hearing in my ear, let`s go back into testimony.
UNIDENTIFIED FEMALE: Please be seated. The record will show the presence of the jury, the defendant and counsel. You may continue.
UNIDENTIFIED FEMALE: Thank you, Your Honor. Ms. LaViolette, did you review an e-mail that was written October 3rd of 2007?
UNIDENTIFIED FEMALE: I bet I did.
UNIDENTIFIED FEMALE: OK. Did you review an e-mail that had to do with Mr. Alexander owing somebody money?
UNIDENTIFIED FEMALE: Yes, I did.
UNIDENTIFIED FEMALE: OK. And that was besides the e-mail that we`ve already discussed with Ms. Hughes, right?
UNIDENTIFIED FEMALE: Excuse me?
UNIDENTIFIED FEMALE: This was in addition to the e-mail that we`ve already discussed regarding the money that he owed to Ms. Hughes?
UNIDENTIFIED FEMALE: Yes, it is.
UNIDENTIFIED FEMALE: OK. All right. I want to talk to you about a journal entry on October 6th of 2007. It`s been marked as 576.
GRACE: There you see Alyce LaViolette on the stand. This may be a Hail Mary for the defense. According to some court watchers, she may actually turn this jury in favor of acquittal. Everyone, family album with your photos, tonight Florida friends, (inaudible), love the beach and fishing. Share your photos at hlntv.com/nancygrace and click on Nancy`s Family Album.
(COMMERCIAL BREAK)
UNIDENTIFIED FEMALE: OK. So on October 6th, if this is a journal entry from Ms. Arias, right, into her own journal?
UNIDENTIFIED FEMALE: Yes, it is.
UNIDENTIFIED FEMALE: OK. And what is it --
GRACE: Everyone, we are back in the courtroom for testimony on the stand, possibly the last defense witness. Alyce LaViolette.
UNIDENTIFIED FEMALE: -- and Travis` -- Mr. Alexander`s impression that she`s become like Deanna Reed (ph).
UNIDENTIFIED FEMALE: I`m sorry, let me stop you there, so maybe let`s back up a second.
UNIDENTIFIED FEMALE: OK.
UNIDENTIFIED FEMALE: Based on your review of this case, do you know who Deanna Reed is?
UNIDENTIFIED FEMALE: Deanna Reed was the woman who Mr. Alexander was in love with and had a relationship with for, I believe, seven years.
UNIDENTIFIED FEMALE: OK. And was he still in contact with her while he was in a relationship with Ms. Arias?
UNIDENTIFIED FEMALE: Yes, he was.
UNIDENTIFIED FEMALE: And was he still in contact with her when he was in a relationship with Ms. Andrews?
UNIDENTIFIED FEMALE: Yes, he was.
UNIDENTIFIED FEMALE: And was he still in contact with her with these other women that you`ve mentioned, with regard to the text messages and the emails that you reviewed, was he still in contact with Ms. Reed as well?
UNIDENTIFIED FEMALE: Yes, he was.
UNIDENTIFIED FEMALE: All right. And based on your conversations with Ms. Arias, how, how, what did she believe about Ms. Reed as far as how Ms. Reed treated Mr. Alexander?
UNIDENTIFIED FEMALE: Objection, hearsay.
UNIDENTIFIED FEMALE: Overruled. You may answer.
UNIDENTIFIED FEMALE: Ms. Arias believed that Deanna Reed was a little crazy. And maybe, well, that she was crazy and jealous.
UNIDENTIFIED FEMALE: All right. And did Mr. Alexander often have Ms. Arias not come into the home or drop him off around the corner to avoid seeing Ms. Reed?
UNIDENTIFIED MALE: Objection, lack of foundation.
UNIDENTIFIED FEMALE: Overruled. You may answer yes or no.
UNIDENTIFIED FEMALE: Yes.
UNIDENTIFIED FEMALE: All right. And is this information, did Ms. Arias ever have any substantial conversations with Ms. Reed?
UNIDENTIFIED FEMALE: Not that I`m aware of.
UNIDENTIFIED FEMALE: So where did this information come from?
UNIDENTIFIED FEMALE: From Mr. Alexander.
UNIDENTIFIED FEMALE: All right. And so in, back to this October 6th journal entry. You said that Mr. Alexander seems to be comparing Ms. Arias to Ms. Reed?
UNIDENTIFIED FEMALE: Yes.
UNIDENTIFIED FEMALE: And this is what Jodi is writing in her journal. Is that right?
UNIDENTIFIED FEMALE: Yes, it is.
UNIDENTIFIED FEMALE: OK. Does she explain what -- why Mr. Alexander feels that way?
UNIDENTIFIED FEMALE: She, she is --

GRACE: We remember American hero, Army Sergeant Steven Deluzio, 25, Glastonbury (ph), Connecticut, Bronze Star, Purple Heart, NATO ribbon, parents Mark and Diane, brother Scott, who served in Afghanistan, fiance Leeza (ph). Steven Deluzio, American hero.
(BEGIN VIDEO CLIP)
UNIDENTIFIED FEMALE: Because he makes her feel very special. And throughout this relationship, it`s one of the things that she continues to say.
ARIAS: It`s not that I didn`t love Travis. It`s not that I don`t still love him. But I really needed to move on.
UNIDENTIFIED MALE: It says, Travis, you`re beautiful on the inside and out, doesn`t it?
ARIAS: Yes.
UNIDENTIFIED MALE: That`s not true based on what you told us here in court, right?
ARIAS: I believed that he had inner beauty, yes.
(END VIDEO CLIP)
GRACE: Inner beauty? You`re kidding me. Because all they`ve done all day long is try to smear Travis Alexander. Matt Zarrell, bottom line, what went down?
ZARRELL: OK, Nancy. One big thing we have to talk about here, is that the jury was -- the defense wanted the jury sequestered. The judge said no. So I don`t want to jump ahead of things here, but this could be No. 1 grounds for appeal should she be convicted.
GRACE: You know what? If we don`t want to jump ahead of things, Matt Zarrell, then don`t. Can we just burn that bridge when we get there?
Alexis Weed, let`s talk about what`s happening in the courtroom. Matt, we`ll worry about the appeal after the conviction. Alexis?
WEED: Yes, Nancy, so it was really different today watching that jury, where that juror seat number 5, just empty. It is vacuous. It looks a lot different, because this juror who was booted off, this juror was probably the most visible juror in the courtroom. She paid a lot of attention to what was going on every day, Nancy.
GRACE: Well, it hurts me to hear that she left the courthouse, being taken out by, you know, bailiffs, by guards, with tears in her eyes. The defense obviously knew that she was anti-Arias.
Dr. Drew`s coming up next, everybody. I`ll see you tomorrow night 8:00 sharp Eastern. We`ll be camped outside the courthouse again tonight, tomorrow night, bringing you everything that goes down in that courtroom. And until then, good night, friend.
