Hello. I`m A.J. Hammer, broadcasting tonight and every night from New York City.
ANDERSON: Hi there, everyone. I`m Brooke Anderson, coming you tonight from Hollywood. And here is something that absolutely boggles our mind. Why in the world do so many men who are with the most beautiful and desirable women in Hollywood wind up cheating on them? It makes no sense. Or maybe it does. The surprising answers are coming up tonight in an explosive showbiz special report you do not want to miss.
HAMMER: But first, Lindsay Lohan gets naked - as Marilyn Monroe. And what may be one of the strangest and eeriest photo shoots we have ever seen. Lindsay gets butt naked to recreate the last shoot of Monroe done just weeks before Marilyn`s sudden death. And no, these aren`t pictures that were leaked out to the Internet somehow. There were actually taken for one of the most respected magazines in the country. Tonight, SHOWBIZ TONIGHT with the photos, the controversy and the real story behind Lindsay`s naked ambitions.
(BEGIN VIDEOTAPE)
(voice over): It`s Lindsay Lohan in a way you have never seen her before. On second thought, you probably have seen this before.
JO PIAZZA, "NEW YORK DAILY NEWS": Lindsay Lohan naked and looking like Marilyn Monroe.
HAMMER: In an eye-popping new cover story for "New York" magazine, a nude Lindsay Lohan and celebrity photographer Burke Stern recreate Stern`s famous 1962 photo shoot with Marilyn Monroe. That shoot has come to be known as "The Last Sitting." Because just six weeks later, Monroe was dead from a drug overdose officially labeled a probable suicide.
KATIE DARYL, "TMZ TV": We were definitely shocked she bared it all.
HAMMER: Even more shocking, Lindsay is admitting to "New York" magazine that she harbors an obsession with Marilyn Monroe. She says, quote, "If you saw my house, I have a lot of Marilyn stuff." But SHOWBIZ TONIGHT can tell you, with reports that Lindsay Lohan is hitting the clubs again, despite her well-known stints in and out of rehab, seeing her channel one of Hollywood`s most tragic figures is indeed shocking and for all the wrong reasons.
PIAZZA: I just find it so creepy because you are looking at the photos with the knowledge that Marilyn Monroe died six weeks later. And, Lindsay Lohan recreating them, you`re looking at Lindsay and you`re like, "You know what? This could happen to you any day."
HAMMER: In her interview with "New York" magazine, Lohan says she had no problem taking it all off to recreate Monroe`s bold photos. Lohan tells "New York" magazine, quote, "Here is a woman who is giving herself to the public. She`s saying, `Look, you`ve taken a lot from me, so why don`t I give it to you myself.` She`s taking control back."
PIAZZA: They`re beautiful photographs.
HAMMER: Jo Piazza of the "New York Daily News" tells SHOWBIZ TONIGHT it`s hard to take your eyes off of Lohan`s pics.
PIAZZA: They`re the exact same pictures that Stern took of Marilyn Monroe, you know, so many years ago. It is a lot of nudity. She is covered up mainly only with a chiffon scarf and another one is the iconic photo of her holding roses up over her breasts.
HAMMER: In her interview with "New York" magazine, Lohan compared Monroe`s drug-related death to a more recent tragedy, the death of actor Heath Ledger. Lohan says, quote, "They are both prime examples of what the industry can do to someone."
But Lohan brushed off worries that she might be headed for a similar fate saying, quote, "I`m not them. But I sure as hell wouldn`t let it happen to me." But with Lohan`s long history with rehab, not everyone is convinced that Lohan is no longer on that dangerous path.
DARYL: We saw her driving crazy, staying up late at night, and having several incidents and trying to go into rehab multiple times and it`s not, you know, working for her.
HAMMER: And although Lohan hasn`t made any major headlines since leaving rehab last year, "TMZ TV`s" Katie Daryl tells SHOWBIZ TONIGHT her recent antics are still disturbing.
DARYL: Lindsay Lohan has returned back to the scene of the crime, mainly, she`s going out to night clubs again and hanging out kind of, you know, late.
HAMMER: This "TMZ TV" video shows Lindsay Lohan leaving a California club and it`s not the first time in recent weeks she`s been seen out clubbing.
PIAZZA: It`s not something that someone just out of rehab typically does.
DARYL: Obviously, she`s staying out late, you know, at nightclubs leaving with water in the hand. But, you know, temptation is still around so we wonder should she be in this sort of environment?
HAMMER: With Lindsay Lohan once again raising questions about her activities, some are hoping this eerie recreation is the closest she ever comes to copying Marilyn Monroe.
DARYL: Obviously when you see the pictures of Lindsay Lohan dressed up to look like Monroe, it is a little eerie because you have remember, Marilyn Monroe died of an overdose. So we just don`t want to see the same thing happen to Lindsay that we saw happen with Marilyn Monroe.
(END VIDEOTAPE)
ANDERSON: And I have to tell you that there are a lot of people trying to make sense out of this whole thing. This comparison, including our guests tonight. In Hollywood, Ken Baker, executive news editor at "E!" Also joining us tonight in Hollywood, investigative journalist Pat Lalama.
Pat, Ken, first, I want to take a look at the side-by-side of Lindsay posing exactly as Marilyn Monroe did in "The Last Sitting" 46 years ago - Marilyn on there on the left, Lindsay on the right. When Marilyn did it, she was famously sipping champagne, said to be a little bit tipsy. So you would think that Lindsay who has been trying to rehabilitate her image after all the rehab, the DUI arrests, would want to distance herself from something like this. Pat, what do you think? Bad idea?
PAT LALAMA, INVESTIGATIVE JOURNALIST: You know what? I think people are going to look at this and go, "Oh, that`s interesting," and then move along. I think it`s going to be a big money maker for "New York" magazine, no doubt about it, sort of like the first person to get the Paris Hilton interview kind of thing. But you know what? I have a theory. What I call it is all is forgiven leg of the Lindsay Lohan express.
In Hollywood, because of the whole sexuality mentality, bare a boob - sorry, I don`t know if I`m allowed to say that I just did - and you`ll have a show. You`ll be forgiven. All is well. It`s the Pam Anderson thing. It`s the Paris Hilton thing that everybody who sexualizes themselves gets right back on the horse.
Unfortunately, I would have rather seen her sit down and say, "I`m going to do an interview and talk to you about the plans for the future, what roles I`d like, what projects I`m working on, how staying healthy." That`s what I would have liked.
ANDERSON: Ken, what do you think? Do you agree that maybe this could be a fresh start for Lindsay in a way?
KEN BAKER, EXECUTIVE NEWS DIRECTOR, "E!": Well, I think it`s actually a really good thing for her. And let`s face it. As long as it`s not a mug shot of Lindsay Lohan, she is making an improvement, OK? So this is something - this is a step up for her.
And the other thing to realize - look at, this is a classic starlet pose from 40 years ago and it`s something that`s beautiful. It`s elegant. And I think that that`s the point that she`s trying to make. So in a counterintuitive way, Lindsay Lohan is really sort of addressing her whole rehab and the drug problems by taking control of her image and projecting this out there. It`s counterintuitive but actually, I think it`s brilliant in a way.
ANDERSON: Well, to that end, I want to take a look again at what Lindsay said about Monroe`s "Last Sitting" photos. She said this, quote, "Here`s a woman who is giving herself to the public. She`s saying, `Look, you`ve taken a lot from me, so why don`t I give it to you myself.` She`s taking control back." Pat, you seem to disagree with Ken but, you know, as strange as it may seem, is Lindsay trying to regain control of her life or is this just a silly publicity stunt?
LALAMA: It`s a silly publicity stunt, and frankly, I mean I was no great Marilyn fan but I can certainly appreciate what she offered. Lindsay is no Marilyn. And I have to tell you, why do these young women want to remix Marilyn? Anna Nicole did it.
I mean how about your own identity? And frankly, I don`t think the pictures are that beautiful. I think they look little cheap. I don`t think they`re horrendous. I don`t think they`re necessarily tacky but I don`t think it does any honor to Lindsay or Marilyn. She should create her own identity and move forward.
ANDERSON: You know, of course, it`s not lost on anybody that Lindsay`s film career has been jeopardized recently by her stints in rehab. Ken, is there any reason for us to believe her doing this could possibly help her career?
BAKER: Well, first of all, I agree with Pat. Lindsay Lohan is not Marilyn Monroe, and that`s a good thing. Marilyn Monroe didn`t go to rehab. She didn`t clean herself up. That`s why six weeks after that photo shoot she did, she died. And Lindsay Lohan is healthier and in recovery and doing better.
So as far as does this hurt her movie career or help it, I think it helps it. Look, the cover of "GQ" magazine has an image of Rachel Bilson. She`s an up and coming star. She is wearing a skimpy bikini on the cover of "GQ." This is considered a great thing. She`s one of the up and comers, someone who`s supposed to be really getting done. I think she`s the next big movie star.
And Lindsay Lohan goes and does it and people want to criticize her. I think there`s a double standard for Lindsay because everyone just wants to dump on her because of her past. Let`s give her a fresh start. She`s done this beautiful photo shoot. She`s trying to get herself back and her career back.
LALAMA: But Ken, why does it have to always be something sexual. Why can`t it be about substance? Why does it have to be, "I`ll show you my breasts and I`m going to get back on the train and be a big movie star? You know, why not class things up a little bit for a change? I don`t think this helps her image. I don`t think she`ll get work.
ANDERSON: Ken, you said it`s a terrific thing. You know, someone posing on "GQ" in skimpy clothing. That may be another subject but Pat does make a great point there.
BAKER: No. I agree that there`s an over-sexualization for sure, but there`s other venues. Look, Lindsay Lohan has done really elegant photo shoots for high fashion magazines. She`s done a lot of that stuff. I think what she`s trying to do, in a big way, is saying, "I`m back. All of you, come on TV and talk about me, and talk about how controversial I am - "
ANDERSON: All right.
BAKER: "Because I want to get attention."
ANDERSON: OK. Well, we will leave there. She certainly did get some attention with this.
LALAMA: Exactly.
ANDERSON: Ken Baker, Pat Lalama, thank you both.
LALAMA: Thank you.
BAKER: Thanks.
HAMMER: Yes. And speaking of getting attention tonight, the battle over Britney Spears heating up. For the very first time, we have the inside story of the lawyers trying to make the battle for control of Britney into a federal case. That`s right. We are revealing the stunning brand new details. Plus, a year after that famous head shaving incident, Britney just spent a quiet little weekend with her family. Is Britney finally on the road to recovery? That`s coming up.
Also, a Paul McCartney-Heather Mills divorce shocker. Is it deal or no deal for Paul and Heather? You know, with so much money at stake, I`ve got to ask, what`s with the mystery surrounding this divorce settlement? We will also have this.
(BEGIN VIDEO CLIP)
MICHAEL YO, "YO ON E!": Stars cheat on their beautiful Hollywood women. Well, it`s simple - it`s because they can.
(END VIDEO CLIP)
ANDERSON: OK. That may be the short answer to why these women, beautiful, talented, successful stars, got cheated on. But hey, I wanted to know more like what hope do the rest of us have if men aren`t satisfied with Halle Berry and Christie Brinkley? That`s coming up in a showbiz special report, "Hollywood Cheaters."
(COMMERCIAL BREAK)
(BEGIN VIDEO CLIP)
PARIS HILTON, ACTRESS: I am so excited to be here tonight, celebrating my birthday.
(END VIDEO CLIP)
HAMMER: Wow. Paris Hilton celebrated her birthday over the weekend at the Pussy Cat Dolls lounge in Vegas. Hey, nothing says, "I`m 27 now and a productive member of society," quite like rolling around in a giant Martini lass and a bra. I`ve got to wonder watching this video, what part of this dance is helping children or finding a cure for multiple sclerosis?
Remember, those were just two of the promises Paris Hilton made when she got out of jail. She was going to do charity work and not go out so much. And how is Paris doing with all of those endeavors she promised us? We are finding out when showbiz investigates, "Paris` Broken Promises," Tuesday. You won`t want to miss that.
You`re watching TV`s most provocative entertainment news show. I`m A.J. in New York. Tonight, there is a big surprise in the Paul McCartney- Heather Mills divorce debacle. The more than week-long, closed door hearing ended today with no deal at all. Instead, the judge in the case is actually going to have to decide the fate himself of Paul`s estimated $1.6- billion fortune.
Joining me tonight from Hollywood, Jane Velez-Mitchell, investigative journalist and author of the book "Secrets Can Be Murder." Also from Hollywood tonight, Atty. Darren Kavinoky.
All right. Darren, Jane, nobody expected the divorce proceedings to go on this long and then for the decision to fall into the hands of the judge. Darren, any sense at all whether it points to a good sign for Paul or perhaps a good sign for Heather?
DARREN KAVINOKY, ATTORNEY: Well, there`s one great sign for both of them and that`s that they`re finally going to get closure on this, on this whole deal. You know, the mudslinging`s been going on for sometime and this is now going to be over is great for both.
And, you know, there`s a saying among those who practice in the area of divorce that there`s a reason that divorces are so expensive. And that`s simply this, A.J., they`re worth it. They`re absolutely worth it. Although, honey, if you`re watching, I`m just kidding - to my wife at home.
But really, one thing we know for sure when the dust settles on this deal that Paul`s lifestyle should not be significantly impacted and I don`t think that Heather`s going to be choosing between a career in food service versus retail. I think they`re both going to come out of this financially OK.
HAMMER: Yes, you know, it`s not like Heather`s going to get half, but even if she did get half, Paul would still have about $800 million. Well, what do you think, Jane? As far as the judge now taking over, making the decision since he couldn`t meditate the decision, is it possibly making Paul a little bit nervous, anything at all to indicate that Heather might have the upper hand here?
JANE VELEZ-MITCHELL, INVESTIGATIVE JOURNALIST: Well, if you watch her leaving court, she always has a big grin on her face like the cat who ate the canary, but of course, you can`t judge from that. It`s always good to sort of project a victorious image.
Listen, it looked like they were close to a deal. There were reports in the British tabloids that they had a deal and somehow it broke down. The question is why? Could it have been that confidentiality clause that Paul was so, so determined to get in there?
You know, Heather Mills feels very maligned. She probably wants to tell her story and set the record straight. That could have been the sticking issue. Another is security. We saw her dragging tons of videotapes into court, trying to prove to the court, "Hey, I am stalked by the paparazzi." In fact, you can go on YouTube and see a video of her being stalked by the paparazzi. "I need extra bucks for security," and perhaps Paul balked at that.
HAMMER: Yes, because you know, I`ve got to tell you. We were all a little surprised by this and wondering why exactly it has come to this. As you mentioned, Jane, there were reports floating around over the weekend that a settlement had, in fact, been reached and then, you know, maybe they were given the weekend to mull it over. So Darren, what do you think? Is it possible, you know, they went home and one of them was saying, "You know what? I don`t really care for this deal so much." Maybe that`s how it went down.
KAVINOKY: Sure. And there`s lots of reasons that settlements can break down other than money. Even if they agreed on the money, there are all sorts of things such as the confidentiality that Jane referred to. That could be a big deal, I mean, especially if your hope is to go back and sling some more mud. The last thing you want is a confidentiality agreement to sort of muck up the works there. So it could just be that after agreeing in the terms of the deal that there`s a buyer`s remorse and one backed out and that sort of stuff happens all the time.
HAMMER: Yes. And Jane, sort of to your point, you know, this divorce as we know the hearing through the whole thing has been kept completely private. But we do know that if Heather or Paul decides to appeal the judge`s decision, once that is announced, all the court information would be made public and the translation there being perhaps some of the dirtiest laundry we`ve ever seen. And Jane, you know, right there, that sounds like a good reason to work things out because, don`t forget, there is also a child involved. They have their four-year-old daughter Beatrice here.
VELEZ-MITCHELL: Absolutely. I don`t think there`s any winners at the end of the day. The most priceless asset that Paul McCartney has is his legacy. I mean, right now, Cirque de Soleil is honoring the Beatles. Across the Universe is based on the Beatles` music. He should be celebrating that. Instead, he`s fighting this battle and we know that Heather Mills actually accused him of some nasty things like drinking too much. And so it could get a lot worse and of course, the press has accused Heather of everything from being a former prostitute to gosh-only-knows- what. So neither are going to win.
HAMMER: Oh, the press hasn`t been kind to her? Is that what you`re saying?
VELEZ-MITCHELL: No, not at all.
HAMMER: Jane Velez-Mitchell, Darren Kavinoky, thanks for being with us tonight.
VELEZ-MITCHELL: Thank you.
ANDERSON: Heath Ledger was working on a new film right before he died. And now, it looks like not one, but three Hollywood A-listers are going to step in to play his character and get that movie finished. We`re going to tell you how that`s going to work, next. We`ll also have this -
(BEGIN VIDEO CLIP)
YO: They say Eric Benet was addicted to sex. You have one of the best- looking women in the world. Have sex with her. How do you ever cheat on Halle Berry?
(END VIDEO CLIP)
HAMMER: Hey, you know, it`s not just Halle Berry who has had to endure the pain of a cheating man. I`ve got to tell you, I really have been wanting to know why would anybody cheat on the most beautiful, most successful, most talented woman in the world? We`re investigating "Hollywood Cheaters." You won`t want to miss it, coming up in a showbiz special report.
ANDERSON: And the battle over Britney Spears heats up. For the first time, we have the inside story of the lawyer who`s trying to make the battle into a federal case. SHOWBIZ TONIGHT is revealing the brand new details, straight ahead.
HAMMER: Right now, we`d like to hear from you for our SHOWBIZ TONIGHT question of the day, "Britney Spears` parents in control: Is she on the road to recovery?" Let us know what you think by voting at CNN.com/ShowbizTonight. You can also E-mail us at showbiztonight@CNN.com.

ANDERSON: Hey, welcome back to SHOWBIZ TONIGHT. I`m Brooke Anderson. And here are some more stories that are new right now. Shocking testimony in the inquest into the deaths of Princess Diana and Dodi Al-Fayed. Al- Fayed`s father is having his day in court after 11 years. He says the royal family was responsible for the crash that killed them, that Diana was pregnant and that the couple was about to announce their engagement. Other witnesses have denied those allegations.
The show will go on for the movie Heath Ledger was filming before his death, "The Imaginarium of Doctor Parnassus." Jude Law, Johnnie Depp and Colin Farrell will all step in to play Ledger`s role. It`s a fantasy film and Ledger`s character steps into three different mirrors that transport him to different dimensions. So the three actors will each play the character in the different worlds.
Kirstie Alley has resigned as the Jenny Craig spokesperson. The company will only say that Kirstie has passed the baton to Valerie Bertinelli and the newest spokesperson, Queen Latifah.
HAMMER: Well, tonight, the battle over Britney Spears is heating up. For the very first time, we have for you the inside story of the lawyer who`s trying to make the battle for control of Britney into a federal case. We`re revealing the stunning, brand new details.
Plus, a year after her famous head-shaving incident, Britney spent a quiet weekend with her family. So the question is, is Britney finally on the road to recovery? Should we get our hopes up? We`ll get into that next on SHOWBIZ TONIGHT.
ANDERSON: All right. It happens all the time in Hollywood. Men cheating on famous, gorgeous women. Why do they do that?
(BEGIN VIDEO CLIP)
YO: Stars cheat on their beautiful, Hollywood women. Well, it`s simple. It`s because they can.
(END VIDEO CLIP)
ANDERSON: OK, OK. That may be the short answer to why these stars got cheated on. But I wanted to know more, like what hope do the rest of us have if men aren`t satisfied with Halle Berry and Christie Brinkley? That`s coming up in a showbiz special report, "Hollywood Cheaters."

HAMMER: On SHOWBIZ TONIGHT, stunning new developments in the battle over Britney Spears. Tonight, the lawyer who is trying to make this into a federal case speaks out. He says Britney`s civil rights are now being violated. But why is this guy butting in in the first place? And who hired him? I mean, Britney does seem to be on the right path now. We are all fired up over this.

HAMMER: Tonight, a showbiz special report, "Hollywood Cheaters." I`ve got to tell you, I just don`t get it. These women are beautiful, successful, so why would their men do an awful thing and cheat on them? We`re getting the bottom of this tonight.
(MUSIC)
Welcome back to SHOWBIZ TONIGHT. It is 30 minutes past the hour. I`m A.J. Hammer broadcasting tonight and every night from New York City.
ANDERSON: And I`m Brooke Anderson, coming to you tonight from Hollywood. This is TV`s most provocative entertainment news show.
HAMMER: Tonight, SHOWBIZ TONIGHT is bringing you big and brand new developments in the battle for Britney Spears` fortune and the unbelievable possibility that this might actually become a federal case. The attorney who is trying to bring this to federal court is now speaking out for the very first time.
The name is Jon Eardley and he`s telling "People" magazine he`s standing by his case and wants a, quote, "return to normalcy for Britney." But I`ve got to say Britney seems to be making a return to normalcy all on her own. SHOWBIZ TONIGHT can reveal she spent a very quiet weekend in Hollywood with the very family she`s been estranged from.
Joining me once again tonight in Hollywood, Atty. Darren Kavinoky; investigative journalist and author of "Secrets Can Be Murder," Jane Velez- Mitchell; also from Hollywood tonight, "Extra" correspondent Carlos Diaz. Gang, I appreciate you all being here.
A thing we`re wondering, who the heck is this guy? Jon Eardley, the attorney who was trying to bring this to federal court, and where the heck did he come from? For the very first time, he`s actually claiming that Britney called him. He gave an interview to TMZ and he claims that Britney didn`t sign a retainer because, well, basically she`s being held hostage in her own home. I`ve got to tell you, Darren Kavinoky, something smells fishy here.
KAVINOKY: Yes. I`m a little confused, too, A.J. I mean, which one of her spacious, luxuriously appointed, giant mansions is she being imprisoned in? You know, in law school, they teach you about something called the grin test which is basically if you can`t say something in court with a straight face, if you can`t say it without grinning, then you better not say it. And frankly, I don`t know that this one passes the grin test. You know?
And the thing that smells funny to me about this whole thing, too, is that he would take any action on Britney`s behalf based just on this phone call. I mean, how does he know that it was even Britney on the phone? The best practice is obviously to have something in writing or even better, have that retainer agreement videotaped.
I wouldn`t be satisfied just having Britney`s signature on a page. I`d want a videotape of it to protect myself. But in the meantime, all of the state court orders are in full effect until the federal courts bounce this thing right out there which I think is eventually going to happen.
HAMMER: Yes. I`m just going to go out an limb here and say, "You know, I don`t think when Britney Spears calls you at home, it comes up Britney Spears on the caller ID. I don`t think that`s happened.
KAVINOKY: Not on mine.
HAMMER: For the record, I need to point out that SHOWBIZ TONIGHT did reach out to this Jon Eardley guy for comment and he declined, saying, quote, "The case speaks for itself." Jane, I can tell you what actually Darren Kavinoky told me last week. A lot prominent people in the legal community are saying, this whole case stinks because a federal court is never going to take this on.
VELEZ-MITCHELL: Well, yes. I`ve heard all the lawyers saying that this is bizarre and crazy, but let`s face it. There are constitutional issues at stake. The lawyer pointed out there are a lot of crazy people doing very crazy things on the streets of every major city and they`re not institutionalized. And now, Britney Spears, as you pointed out, has been spotted, very lady-like, going to dinner.
So why is she so incompetent that she does not have the right to hire her own lawyer and others have to make decisions for her about her medication? And I think that there could be some sexism at work. If you look at a 50-year-old man, for example, who is having a midlife crisis and making a lot of bad judgment and hanging out with the wrong people and going out with young women, you might say, well he`s having a midlife crisis. You`re not necessarily going to institutionalize him. But with a young woman like Britney, I think it`s no holds barred, especially given the kind of coverage she`s gotten.
So, I think for all of our sakes, I wouldn`t want anybody locking me up because I`ve made a bunch of bad decisions. And I think this man, even though he may be out of bounds legally, is raising some very important questions about civil liberties.
HAMMER: Carlos Diaz, I see you shaking your head and I heard a loud sigh there.
CARLOS DIAZ, INVESTIGATIVE JOURNALIST: Jane needs to be locked up after that last argument. Come on, Jane.
VELEZ-MITCHELL: As long as you`re locked up with me, Carlos.
DIAZ: Well, that`s another show altogether. But listen. OK. Jane, you made a point. Yes, she was at a dinner this weekend because she was with her dad. She hasn`t gone to dinner like in the past several months because she`s been out on her own, you know, kind of acting erratically. She`s back to the normal Britney because of her parents.
VELEZ-MITCHELL: But not because of the conservatorship, Carlos, because mom and dad came back into the picture.
DIAZ: No.
VELEZ-MITCHELL: My question is why didn`t they come back and fixed her months ago when she first started acting like looney tunes?
DIAZ: Because -
VELEZ-MITCHELL: Why did they wait until she totally lost and then came in and grabbed her estate?
DIAZ: Because the conservatorship is the only reason Britney has to listen to her parents now. Before, she would tell them, "Hey, get out of here." Now she has to listen to her dad because her dad has control of all the money and all the assets and things like that. So the conservatorship is the reason Britney is sane now.
HAMMER: Well, yes. Hold on. Let me give this a greater context because Carlos, I think you make a very good point. Can we throw up that split screen for a second, Charles?
Take a look at this. On the left-hand side, you see the bald Britney after she shaved her head in public. That is a year ago. That is almost to the day a year ago, the very beginning of the whole meltdown phase. On the right, it`s Britney out and about over this past weekend. And again, we`re happy to report she`s not carrying on. She is acting normal and she`s hanging out with her family. Jane, it seems to me that the whole conservatorship with her parents is doing some good with them in control.
VELEZ-MITCHELL: A.J., go gown to Venice Beach. You`ll see a lot of people who look just like the before picture of Britney. Again, you can`t say it`s unconstitutional to have bad judgment, because you`d lock up half the country for having bad judgment. I`m not saying she doesn`t have mental illness.
But I spoke with a psychologist who said that she felt having handled many, many conservatorship case, this was premature. Usually, people are put under conservatorship after several, maybe even a dozen hospitalizations. And the fact that she has money to hire people to take care of her should be another mitigating factor.
And finally, that addiction is a not a criteria for creating conservatorship. Remember, after she shaved her head, she went into rehab. So I think there`s a lot of complex issues here and we just can`t say she is bonkers, take away all her rights because that`s not how America works.
HAMMER: Yes. You make very a good point and that I guess what this lawyer is trying to get through the federal court if ever it makes it that far. We know that Britney has had a rough time with her parents in recent years.
Now that they have stepped up to the plate and taken control, SHOWBIZ TONIGHT reached out to our audience. We asked the question on air and online at CNN.com/ShowbizTonight, "Britney Spears: Do you trust her family to take care of her?" Fifty percent voted yes, fifty percent no.
And I`ve got to tell you, this was a huge response. We`ve never had a poll that was split exactly down the middle. Carlos, I know you`re out there covering the Britney beat day in and day out as well. Who do you trust?
DIAZ: It`s not whom I trust implicitly. It`s not do I trust her parents 100 percent or do I trust other people 100 percent. I trust Britney`s parents more than I trust Sam Lutfi and Adnan Ghalib. So it`s kind of like the lesser of two evils here.
I think that her parents` track record over the last several weeks is much better than the track record of Sam Lutfi. I think your poll on CNN.com is startling that people are split down the middle at 50-50 but I would have to go toward the parents more than I would her past influences.
HAMMER: Well, hopefully, you know, whatever it is, it seems to be working and we`ll continue down that path as I seem to continue to say every single night. I don`t think we`re going to see it in federal court. Darren Kavinoky, Jane Velez-Mitchell, Carlos Diaz, I do appreciate you all being with us tonight.
ANDERSON: All right. Here`s something that`s really hard to fathom. You have some of the hottest women in Hollywood like Sienna Miller, Elizabeth Hurley, Halle Berry and their guys cheat on them.
(BEGIN VIDEO CLIP)
YO: They say Eric Benet was addicted to sex. You have one of the best looking women in the world. Have sex with her! How do you ever cheat on Halle Berry?
(END VIDEO CLIP)
ANDERSON: I mean, it is absolutely disgusting, and I want to know why they do it. You`ve got to stick around for my showbiz special report on "Hollywood Cheaters."
HAMMER: I`ve got to tell you, I think it is great that Janet Jackson and her man, music producer Jermaine Dupree have been going so strong for a while. Didn`t look like any cheating is happening there. Coming up, we`re asking Janet the question everybody is wondering about. Will she and her brothers Michael, Tito and Jermaine ever work together? Her surprising answer, coming up next.
And you know, Las Vegas with the lights, the liquor, the late nights, it can get really crazy. Just ask Ashton Kutcher and Cameron Diaz. They met, they married, they made millions all in one day. You`re not going to want to miss your first look at their very funny movie that`s brand new. Coming up on SHOWBIZ TONIGHT.
(COMMERCIAL BREAK)
HAMMER: I`m A.J. Hammer. Tuesday on SHOWBIZ TONIGHT, whatever happened to Paris Hilton`s promises to do everything from fighting breast cancer to helping women in jail? At 11:00 p.m. Eastern and Pacific.

(BEGIN VIDEO CLIP)
JUDE LAW, ACTOR: When a girl of this mind blowing caliber invites you to a party, it is time to get going and start flowing.
(END VIDEO CLIP)
ANDERSON: That was Jude Law playing a big-time womanizer in the 2004 film "Alfie" just one year before he admitted publicly to cheating on girlfriend Sienna Miller.
Welcome back to SHOWBIZ TONIGHT, TV`s most provocative entertainment news show. I`m Brooke Anderson. So what`s the deal with men who cheat on the most beautiful, successful women in the world? It`s hard to believe that somebody would actually do that to Halle Berry or Christie Brinkley, but it does happen and it keeps happening in Hollywood over and over again. But why? Tonight, it`s a showbiz special report, "Hollywood Cheaters."
(BEGIN VIDEOTAPE)
ROBIN GIVENS, ACTRESS: You know, I`m sick and tired of men using love as if it`s some disease you just catch. Love should have brought your ass home last night.
ANDERSON (voice over): When it comes to cheating, it`s not just in movies like "Boomerang." It`s an ongoing mystery in Hollywood, men who cheat on the near perfect women. Halle Berry. Sienna Miller. Elizabeth Hurley. Even legendary cover girl Christie Brinkley. All stunningly gorgeous. All incredibly successful. But they have one unenviable thing in common - they have all been cheated on. So SHOWBIZ TONIGHT has to ask, why do men cheat on the topnotch ladies of Hollywood?
JUDY KURIANSKY, CLINICAL PSYCHOLOGIST: There are several reasons why a guy would cheat on those gorgeous, famous and rich Hollywood stars. It could be due to his low ego. Could be due to a mid life crisis. Could be he`s got a sex addiction. Or it could be that he splits women and has what we call a Madonna-Prostitute syndrome. Not Madonna the rock star but Madonna the Virgin Mary.
YO: Stars cheat on their beautiful Hollywood women. Well, it`s simple - it`s because they can.
JAY LENO, TALK SHOW HOST: What the hell were you thinking?
ANDERSON: It`s a moment we`ll never forget. A humiliated Hugh Grant on "The Tonight Show" getting grilled after cheating on girlfriend Elizabeth Hurley.
HUGH GRANT, ACTOR: I think you know in life pretty much what`s a good to do and what`s a bad thing. And I did a bad thing. There you have it.
ANDERSON: Yes, a really bad thing. In 1995, Hugh and Elizabeth were the toast of the town until he was caught doing a little hanky panky with prostitute Divine Brown.
YO: Hugh grant, we need to talk. Seriously. You have one of the best looking women in the world. You did have Elizabeth Hurley. But then, you go and cheat with a prostitute? And not only is the prostitute not attractive, she looks like a crackhead. Seriously.
KURIANSKY: When a guy has sex with a prostitute and he`s got a hot woman at home, usually he`s got what`s called the Madonna-Prostitute syndrome. He has to have wild, erotic sex with a prostitute and he keeps the gorgeous woman at home as pure and separate from his erotic fantasies. So it`s likely that Hugh Grant has some sexual fantasies and acts that he didn`t want to ask Elizabeth Hurley to act out with him as if the woman who he`s really with would say, "What? I wouldn`t do that."
ANDERSON: Well, from one very bad decision to a broken fairytale. Halle Berry was already a Golden Globe winner in 2001 when she married R & B singer Eric Benet. It was all but a dream realized until Eric cheated on Halle and couldn`t stop.
YO: They say Eric Benet was addicted to sex. You have one of the best looking women in the world. Have sex with her. How do you ever cheat on Halle Berry?
KURIANSKY: Halle Berry could stand on her head. She could be the sexiest woman alive, which she is. It doesn`t matter. If a guy like Eric Benet has what we call a sex addiction, he just can`t keep his pants on.
ANDERSON: If sex addiction was Eric Benet`s excuse for cheating on Halle, SHOWBIZ TONIGHT is asking, what was Jude Law`s excuse for cheating on Sienna Miller?
SIENNA MILLER, ACTRESS: What is your name?
LAW: Alfie.
ANDERSON: Jude met the beautiful and talented Sienna Miller on the set of a movie "Alfie," a movie where Jude played, of all things, a womanizer.
MILLER: Don`t worry. I`m already gone.
ANDERSON: Sienna definitely gone after Jude admitted to cheating on her with his children`s 26-year-old nanny.
YO: Let`s think about this, Jude Law. Your girl, Sienna Miller, who was in every magazine, looking sexy, looking beautiful. Has a great career. Has a lot of money and you throw it all away for a nanny?
KURIANSKY: Some guys are really threatened by a woman who is equal to them. They want to go for something that`s easy. What could be easier than a nanny who adores you?
ANDERSON: What was easy for Jude Law was also easy for Christie Brinkley`s husband, Peter Cook. In 2006, Mr. Brinkley admitted to cheating on legendary cover girl Christie Brinkley with a then-17-year-old girl.
YO: I`m just thinking about Peter Cook`s pickup line to the little girl. It was like, "Hey little girl. Want some candy?" I mean, ugh.
KURIANSKY: He`s the Mr. Christie Brinkley. It insults his ego. His narcissism is truly hurt and as a result, he looks elsewhere.
ANDERSON: Eric, Jude, Hugh and Peter have all publicly said they`re sorry. But SHOWBIZ TONIGHT wants to know if these ladies of Hollywood can`t keep their men at home, do the rest of us even stand a chance?
KURIANSKY: They can`t be more beautiful, or richer, or more famous in order to tame that man and make him only want her. It is not her problem.
YO: To the ladies of Hollywood, if you don`t want your hot, Hollywood men cheating on you, it`s very simple. Don`t let them go outside.
ANDERSON: Well, in Hollywood, that seems easier said than done.
(END VIDEOTAPE)
Now, luckily, all these women have moved on but not without baring scars. After divorcing Eric Benet, Halle Berry stated publicly that even though she doesn`t negativity to Eric, she will never get married again.
HAMMER: Well, tonight, I`ve got some absolutely amazing news. If you have ever dreamed of a Jackson Five reunion with some Janet Jackson thrown in, hey, you may be in luck. With brother Michael out with his 25th anniversary "Thriller" album, there have been all kinds of whispers floating around that the Jacksons may actually get together and do some kind of a superstar record. Wow. That would be something.
Now, you`ve got to listen up and hear what Janet Jackson told us when SHOWBIZ TONIGHT went one on one with her and asked her if she, Michael, Tito Jermaine and the rest could all hook up.
(BEGIN VIDEO CLIP)
JANET JACKSON, SINGER: I know that there definitely is something they want to do and excited about it. And one of my brothers has had a solo career and he kind of - you have to respect it. He may want to just stick with his solo career and you have to respect that. So I don`t know . He`s kind of on the fence about it but I`m not giving up. I`m still going to work very hard. I`m really going to get on his nerves until he says, "Fine! I`ll do it."
(END VIDEO CLIP)
HAMMER: Yes. You`ve got to admit it would be pretty epic. By the way, Janet is about to release her new album. It`s something she worked on with her long-time boyfriend Jermaine Dupree. So we had to ask, do they really get along that well both in and out of the studio?
(BEGIN VIDEO CLIP)
JACKSON: We`ve never butted heads, ever, when it comes to work. And I hear a lot of people say what you just said. Oh, oh, it wouldn`t work out. If there`s something that we disagree on, we really try to figure it out and see what`s best for the project whatever that may be. We`ve never argued in the studio. None of that stuff. He`s really easy to work with.
(END VIDEO CLIP)
HAMMER: I`ve got to tell you, that`s good to hear. There`s no word if they will in fact ever get married. Janet`s new album "Discipline" is out on February 26th.
