Oprah Winfrey says she`s sorry about the drama surrounding her $38,000 handbag hoopla.

Paula`s crisis. Racial discrimination claims against Paula Deen tossed out in a lawsuit. But SHOWBIZ TONIGHT reveals why Deen`s goose still looks cooked.

SHOWBIZ TONIGHT starts right now.

Hello, everybody. I`m Nischelle Turner in for A.J. Hammer. And we begin with our first "SHOWBIZ Countdown" of the night. We are counting down today`s top three "Stars in Crisis," and we`re kicking it off with No. 3, Paula Deen.

It would seem that Paula has a lot to celebrate tonight after a judge dismissed part of a racial discrimination suit against her, because the woman who filed it and used to work for her is white. But SHOWBIZ TONIGHT can tell you it`s not all what it seems, despite Paula`s tearful pleas like this on "The Today Show."

PAULA DEEN, CELEBRITY CHEF: I`m heartbroken. I`m thankful for my partners.

MATT LAUER, CO-HOST, NBC`S "THE TODAY SHOW": Why? Heartbroken for yourself or your family?

DEEN: Heartbroken. I`ve had to hold friends in my arms while they sobbed, because they know what`s being said about me is not true.

TURNER: Now, as we know Paula Deen`s empire pretty much collapsed since it was revealed she used racial slurs. But despite this new ruling, Deen still seems to be done, well done.

Celebrity chef Jason Roberts is in New York, and he`s one of the stars of ABC`s "The Chew." And in Hollywood, attorney Lauren Lake, who is also a judge on the new syndicated TV show "Paternity Court," which premiers September 23.

Lauren, I want to start with you and I want to give you our countdown question. Does this shocking new court decision really mean Paula Deen is officially not guilty of racism?

LAUREN LAKE, ATTORNEY: No, it does not. It just simply means that the person bringing the suit, these allegations, doesn`t have standing, because they`re not part of the group that she allegedly discriminated against.

And that`s the problem. That`s why it`s so hard for Paula to rehabilitate herself and regain her empire, because she admitted in that deposition that she used the racial slurs, and that was made during a time when she swore to tell the truth, so she told on herself. Now, whether that amounted to discriminatory practices has not been proven, but we know she used the slurs. And I think people are distancing themselves from her because of that alone.

TURNER: It`s a hard word to come back from. That`s for sure.

You know, Deen`s people today, though, are doing a little victory dance after the judge`s decision. Here`s what they just told SHOWBIZ TONIGHT.

They said, "As Ms. Deen has stated before, she`s confident that those who truly know how she lives her life know that she believes in equal opportunity, kindness and fairness for everyone."

So Jason, I want to ask you, because you`ve been a bit sympathetic to Paula in the past. What`s your reaction to the racism part of the suit being thrown out?

JASON ROBERTS, CELEBRITY CHEF: Well, I guess maybe she will be throwing a little bit of a party tonight. But it`s -- it`s a bittersweet ending. I mean, she lost an incredible amount of endorsements for someone who`s built an empire over the last many years, teaching people how to cook and love.

But if you really understand Paula`s case and realize that many years ago she was agoraphobic. She didn`t leave the house. She did what she needed to. She was sending the boys out selling bag lunches. I mean, she`s come from some really hard times.

And to see the demise of this and potential fans not see that love that she has for people, I mean, these are hard times for her. I think she needs to hide for a little while still. She still has the sexual harassment case, which I don`t understand. She`s Paula Deen.

TURNER: Well, you know what? I want to talk about that, though, because you made a good point. She`s not out of the woods yet.

ROBERTS: No.

TURNER: Because the judge did not throw out the sexual harassment...

ROBERTS: yes.

TURNER: ... part of the suit which claims that her brother and business partner made crude remarks and displayed porn at work. So Lauren, let me go back to you. Because even if Paula is held liable for sexual harassment, could that hurt her any more than she`s already been hurt?

LAKE: Absolutely. I mean, it could just keep getting worse.

What we want to know and what we want to believe about this, you know, this chef, this celebrity chef, is that she values people. She doesn`t want to just nourish people through food but that she values life as a whole. Wants to be good to all people.

Now, whether she`s exhibiting issues that surround racial slurs or she`s having business arrangements with a brother that`s treating women unfairly, these are important and it`s going to affect whether or not people want to buy into her and buy her products.

And I am hoping that, you know, for her sake that these allegations aren`t true, but if they are, it most certainly can get worse. I mean, you go to a store now, Nischelle, and everything is on sale.

TURNER: Yes.

TURNER: You can get Paula Deen for $2.

TURNER: Yes. You`re right. You`re right; it definitely has hurt her brand.

But I want to touch on something that gives you an idea of what Jason was talking about, gives you an idea of what this race scandal has cost Paula Deen. Let`s look at this: all the big companies that have dumped her since the scandal broke.

You have the Food Network. You`ve got Sears, Kmart, Wal-Mart, Walgreen`s, Target, the list goes on and on. Altogether, this scandal reportedly has cost her more than $12 million.

Now, this morning, the experts on "The Today Show" said that Paula could have done some very simple things that could have prevented this all. Look at this.

SAMANTHA GUTHRIE, CO-HOST, NBC`S "THE TODAY SHOW": Are you shocked that Paula Deen and her lawyers didn`t settle this case? If they had, this deposition may never have been taken. This may have never come out.

STAR JONES, MEDIA PERSONALITY: Settle it for a little bit of money, penny wise and pound foolish, and this is what you get.

UNIDENTIFIED MALE: When you`re a corporation, you always settle.

TURNER: Lauren and Jason, you know, they bring up a good point. I want to ask you this now, Jason, our "COUNTDOWN" question.

Should Paula just have written a check to make this lawsuit go away?

ROBERTS: Absolutely, I -- here`s the reason why. I`ve seen this happen before. I`ve seen people who work for people, and they premeditate these things. They come up with a diary of sexual harassment, racial slurs. And I`ve seen situations where that same person has made a deal with someone, a corporation. They`ve got the money, and then they went and did it to someone else. I`ve seen repeat offenders. That`s how I feel this happens.

TURNER: You know, and these are all good points. This was a great conversation. But I want to move to No. 2 of our countdown, today`s "Stars in Crisis," because it`s "Two and a Half Men" star Angus T. Jones.

And reports said he may be on the verge of a breakdown. "New York Daily News" reported today that Jones, who is 19 years old, in a bad place, and he`s growing his hair, that he`s losing a ton of weight, all of this to make everyone forget about his role as Jake in the hit sitcom.

Now, last November he shocked everyone when he appeared in a video that was released by his church where he bashed his own show. Watch this.

ANGUS T. JONES, ACTOR: If you watch "Two and a Half Men," please stop watching "Two and a Half Men." I`m on "Two and a Half Men," and I don`t want to be on it. Please stop watching it. Please stop filling your head with filth.

TURNER: Well, since then, his role on "Two and a Half Men" has been reduced. He`ll reportedly only be a recurring character when the show returns this fall.

So Lauren, let me ask you another countdown question. Is Angus T. Jones a star in crisis?

LAKE: You know, I think as we watch young people who have, you know, experienced this type of celebrity, we always have to be careful and understand that any person at that age is very vulnerable.

Imagine living that out in front of the cameras and then being a part of a show that got that much attention. I think we do have to be concerned and also understand that, instead of being in constant judgment of him, be in support of him.

He`s obviously exhibiting some very strange signs now, and he might just need a little bit of space. And I`m hoping he has good people around him that are able to counsel him and also protect him, and give him that room at this very, you know, vulnerable time in his life so he can get it together. Nobody wants him to go down the wrong road.

TURNER: I`ve seen the pictures, guys, and yes, he looks a little disheveled. But you never know: he may just be a 19-year-old going through that 19-year-old phases.

So we are up to the big reveal. Who is our No. 1 star in crisis? This star`s problem may also drag down the rest of his family. Lauren, Jason, stay there.

TURNER: Welcome back to SHOWBIZ TONIGHT. And it`s time for the big reveal: What`s No. 1 in our "SHOWBIZ Countdown" of today`s "Stars in Crisis."

It`s startling new revelations about former NFL tight end Aaron Hernandez. He`s in jail right now, accused of murdering his friend. And we learned today cops are taking a close look at his fiance.

The big issue, the gun cops say Hernandez used to kill his friend has not been found. And police think the key to this murder mystery just might be Hernandez`s fiance.

Here`s CNN`s Susan Candiotti for SHOWBIZ TONIGHT.

(BEGIN VIDEOTAPE)

SUSAN CANDIOTTI, CNN CORRESPONDENT (voice-over): Did the fiance of fallen football star Aaron Hernandez help him hide a murder weapon? It`s a possibility police are apparently considering as they desperately try to find a .45 caliber gun used to kill Odin Lloyd on Father`s Day.

PAUL GALLAN, LEGAL ANALYST: If Ms. Jenkins is tied into misconduct, she`s in very serious trouble. She`s an accomplice after the fact to a murder.

CANDIOTTI: The theory revealed in new search warrant affidavits obtained by Hernandez`s hometown newspaper, "The Bristol Press" in Connecticut. In the ten days before Hernandez was arrested, fiance Shayanna Jenkins was seen coming and going from their home. She`s also seen on different surveillance video leaving the house after receiving a mysterious message from the former New England Patriot.

The documents reportedly state his fiance allegedly puts a rigid object into a car, according to an affidavit, and returns a half hour later without carrying anything back inside the house.

Remember, these surveillance stills taken inside Hernandez`s home show him in the house just before and after the murder of Odin Lloyd, holding what prosecutors believe is a gun.

Another defendant, Carlos Ortiz, allegedly told police that after the murder Hernandez put two guns into a lock box. Warrants also were executed at a storage facility in Bristol where Hernandez allegedly rented a unit. Investigators also searched a lake near his uncle`s home and planned to search another pond nearby this week.

CALLAN: Even if the murder weapon is not found, this appears to be a very strong case against Mr. Hernandez.

TURNER: That was CNN`s Susan Candiotti.

Now, we`ve been unable to reach Hernandez`s lawyers to find out what they have to say about his fiance.

So let`s bring back attorney Lauren Lake, who`s also the judge in the upcoming syndicated show "Paternity Court." Now, Hernandez`s fiance has been standing by her man, Lauren, even though he`s accused of killing her sister`s boyfriend. So it had to be only a matter of time before police started looking at her, right?

LAKE: A matter of time. I mean, they were going to look at her regardless. However, when your own sister suggests that you may have something to do with it, you are most certainly now on the hot seat.

TURNER: Now, why do you think Hernandez`s fiance is sticking with him? I mean, he`s been alleged to do all these awful things, and this is, in fact, to her sister`s boyfriend. Does that seem odd to you that she is standing by him like this?

LAKE: That -- you look at that, and you say why do women stand by men that may not be good for them? It`s this. If we have the answer to that million-dollar question, we could probably empower women exponentially in a matter of seconds. Women fall in love with men that do bad things or make poor judgments, and they still love them. They try to stick by them. Maybe they think they can change them.

Maybe she`s even fearful. Maybe it`s a financial advantage. We don`t know the reason why, but the problem in this case is, is her standing by him if she potentially had something to do with that murder, she`s in trouble.

TURNER: Yes. Well, he can`t bring home a check if he`s in prison. Thank you very much, Lauren.

And we have got breaking news: Katy Perry, John Mayer, together forever. Well, at least musically. The on again, off again couple has a brand-new love duet.

We begin in number three with a big twist in Oprah Winfrey`s Swiss dis. And it`s Oprah saying she`s sorry, Oprah on the record about the fallout that happened when she suggested a store clerk in Zurich, Switzerland wouldn`t show her a $38,000 purse because she was black. Here is what she just told SHOWBIZ TONIGHT at the Hollywood premier of her new movie, Lee Daniels` "The Butler."

OPRAH WINFREY: I think that incident in Switzerland was just an incident in Switzerland. I am really sorry that it got blown up, I purposely didn`t mention the name of the store, I`m sorry that I said it was Switzerland. I was just referencing it as an example of being in a place where people don`t expect that you would be able to be there. It is not an indictment against the country or even that store, it just was, you know, one person who didn`t want to offer me the opportunity to see the bag. So no apology is necessary from the country of Switzerland.

TURNER: So, Oprah is asking for everybody to just calm down for a second. I want to bring back Sinbad, whose new comedy movie makes me want to (inaudible), it`s hitting select theaters August 22nd. Sinbad was me from Hollywood tonight. Sinbad, here`s the questions - did Oprah even really have to say she was sorry?

SINBAD: You know what, when you can buy a $38,000 bag, you don`t say I`m sorry to anybody.

(LAUGHTER)

SINBAD: The fact that you can buy a $38,000 - you know you`re not even black any more. That was not a black person buying that bag. When you have $38,000, you`re in the other category, just black, white, and other. You`re other. I mean I have been stopped many times for buying $38,000 bags because I was running out the door.

(LAUGHTER)

SINBAD: And that`s a whole - that`s a different thing. That`s just because it wasn`t mine.

(LAUGHTER)

SINBAD: But Oprah, that was her bag.

TURNER: You know, Oprah could buy the bag, the store, and probably Switzerland. And we should probably be clear as well, she is not saying that the incident didn`t happen. She`s saying that she`s sorry it made headlines around the world. So, let me bring in attorney Lauren Lake, who is also in Hollywood tonight. Lauren, what do you think about all of this?

LAKE: You know what, I think she did the right thing. Because this sent everyone in an uproar, and the truth is, she was just talking about one experience she had with one clerk at one store. I am not making the judgment on the entire country of Switzerland, let`s get it together, people. But at the end of the day, Oprah never saw that bag. So, even though the clerk is saying that, you know, I didn`t refuse the bag, why has not Oprah Winfrey seen the bag she wants to see?

TURNER: . didn`t even .

LAKE: That`s a problem on all levels. If I was her boss, I would have an attitude, because that bag could have been sold that day.

TURNER: Well, her boss is standing by her. And by the way, the bag did sell anyway on a different day.

LAKE: It did.

TURNER: It wasn`t - Sinbad didn`t buy it.

LAKE: Wow.

TURNER: Yeah, it did?.

LAKE: So, they could have sold two then.

SINBAD: Thank you.

TURNER: There you go.

Oprah isn`t the only one of guys, so, saying she`s sorry for what she did. Let`s go to number two on our "Countdown Tonight." It`s Kate Upton saying why did I do that. The supermodel is now saying that she regrets the first time she posed the cover of "Sports Illustrated" on the swimsuit issue. Here`s what she just told L Magazine. She said, "After my first "Sports Illustrated" cover, I felt terrible about myself for a solid month. TURNER: You know, but here`s the thing.

TURNER: On her bad day, she wears a bikini better than most of us do. And she posed half naked for this swimsuit issue, and now she`s surprised that the fellows are giving her, you know, that side eye second look? Come on.

SINBAD: No, it`s not that. Did you know that she said married men kept looking at her. I think if a single man had looked at her, maybe it would have been different. But I don`t get it. You`re wearing a bathing suit. You`re famous enough because you owned (ph) "Sports Illustrated." I mean - dang .

TURNER: And you know what?

SINBAD: So, why are you tripping?

TURNER: Most people are saying dang when they look at that. Look at her, she`s gorgeous. And after that .

SINBAD: I`ve never seen it. I don`t look - I mean - oh, I guess that`s the first time I saw it.

TURNER: Yeah, I am sure that this is the very first time you`ve ever seen it, Sinbad. So, you`re welcome, you`re welcome for us giving you a little sneak peek. But after that, month of regret - you know, she must have been OK because she did this again. She posed for the "Sports Illustrated" swimsuit issue again this year, and this time she was half naked in Antarctica. And watch what she told SHOWBIZ TONIGHT A.J. Hammer when he asked her if she would like to go to Fiji or Tahiti next time. She had no objections. Look at this.

KATE UPTON: Well, that was so amazing about "Sports Illustrated" is, they have the power to send all the girls to all seven continents .

A.J. HAMMER: Yeah.

HAMMER: But what was the point of doing all seven continents? And it really is a spectacular. I don`t think you`ll get that kind of light in a studio.

But if you were to do this again, because I`m thinking three covers in a row. That would be a brand new record, right? Where would you want to go and shoot that cover?

TURNER: OK, so you heard of there, Lauren. She`s ready to go, she is ready to do it again. So, is she wrong, though, for a man - for wanting a man to see her beyond just the bikinied body?

LAKE: Well, No. Because I think most women do. Let`s be honest. This is her job. Getting covers is a fantastic accomplishment. And that should be her goal, just to be the woman on the cover. But ultimately she`s got to understand that this - it goes with the job. You do a cover of a magazine so people can look at you. Upon looking at you, they may then judge you or want to look at you in a certain way if they see you in person, so objectification comes with the job. You get paid very well, take it. Quit all this crying.

TURNER: Well, Sinbad, let me ask you real quick, though, since, of course, we just, you know, introduced you to the "Sports Illustrated" swimsuit issue and you`ve never, ever, ever in your life seen it before, what do you think? How did she look?

SINBAD: Yes. Well, I`m going to say something. I felt bad. I did a "Playgirl," I did a scene for "Playgirl", and I feel objectified.

SINBAD: And I have women not seeing me for who I was. And that did bother me. So I do understand that I am more than a body.

TURNER: You know what?

New York Mayoral candidate Anthony Weiner is taking on new questions about his second explosive sex scandal. No, your problems aren`t behind you, Mr. Weiner, they`re actually all over you because when we look at you, we are constantly reminded of your bad judgment and your bad decisions and we do not want that type of person in office and that`s the issue he`s going to have to overcome, and he`s not doing it very well so far.

TURNER: Lauren, I am glad I am not your child to ever get a talking to when I do something wrong.

SINBAD: Wow.

Welcome back to SHOWBIZ TONIGHT. John and Katy`s new song just revealed today. It`s one of our top stories in today`s hot flashes. And who better to tackle today`s hottest headlines than one of Hollywood`s hottest music producers. Rodney Jerkins has produced music for Beyonce, Rihanna, Mariah Carey, even Justin Bieber, and now Rodney is breaking out as a big reality show star in his own right. He`s starring alongside his beautiful wife Joy in their brand new family reality show "House of Joy," which airs on the Nuvo network.

Rodney, Joy, welcome, great to see you guys.

RODNEY JERKINS, PRODUCER: Hey, hey.

TURNER: Hey, hey. I am doing great, how are you guys doing? Doing good?

JERKINS: Great.

TURNER: You`re ready to talk, let`s talk. First up, we`ve got to talk about John and Katy writing this song together. Now, Rodney, you heard those lyrics that John was singing about, trying to run away from a relationship in the past, but he`s not, not going to do it anymore. Do you think he is referring to Katy Perry in this song?

JERKINS: Yeah. I think he went through a moment where he wanted to write something that was real to him. I had that moment with my wife. I remember writing a song, when we got married, I wrote a song called "In the Moment," you know, with her and one of our writers from Nashville, and it just becomes this real thing. And I remember, we got on our honeymoon, I wrote a song called "The One," and it was just all about my journey with my wife. So I think they`re having that moment, whether they are together or not. The song was done before, and it was at a moment when they were, looks like they were in love. The song says it all.

TURNER: It does. You mention that he was having a real moment. I don`t know any man hasn`t had a moment of trying to run away from a relationship. So he probably was. You know, Katy seems to be singing about a guy too who just can`t quite commit. Let`s listen to this.

TURNER: First of all, I have to tell you all, the more I hear this song, the more I like this song. If we are to assume that these two are singing about each other, Joy, do you think this could be kind of a match made in heaven? I don`t know.

JOY ENRIQUEZ, "HOUSE OF JOY": I think that when artists get together and musicians and they love the same thing, it`s just that no matter how many fights you have, how many times you might be pulled away from each other, music can always bring two people together. And she`s a great writer, he is a great writer, and they`re both musical, I am telling you, Rodney can have -- we could have the worst, the best, the best, the worst, but when we play music, I think everything just kind of goes away. I think that`s what you see there.

TURNER: I agree.

ENRIQUEZ: The best to both of them.

TURNER: It is beautiful, it is. Let`s go on to our next SHOWBIZ hot flash, not so beautiful here. The big battle brewing between Usher and his ex-wife, Tameka. Usher won the custody battle for now after his son nearly drowned in his pool while he was in court. He took the stand, he recounted the absolutely chilling story of what happened when his son was rushed to the hospital. Take a look at this, guys.

UNIDENTIFIED FEMALE: I don`t know my son is going to be 100 percent the boy he was before this incident.

TURNER: Clearly emotions are running high for both of them. At one point, though, even with all the bad feelings, they hugged. They hugged at the end of this, Rodney. But clearly someone is going to be disappointed when custody is finally settled next month. Do you have a side in this, is it hard to pick a side, Usher or Tameka?

JERKINS: It is really hard to pick a side. Usher is a great guy. And I really wish him well. I think more than anything, we just have to pray for his son, pray for their son, because that`s a horrible ordeal for anyone to go through, the parents and the child. So you know, it is sad, but you don`t want to ever see it be a battle, a public battle over a child after an incident like this. It is really sad.

TURNER: Well said. Go ahead.

ENRIQUEZ: And when media is in it, too, I think it is hard, it is like they`re in the hospital, and the custody, I think like Rodney said, wow. As a mother, I could understand how she feels, and then as a father, they`re great parents. They love their children.

TURNER: At the end of the day, that`s all you want is for your kids to be safe. You guys stay right there. Our next SHOWBIZ hot flash is about Miley Cyrus, who is catching a lot of heat for this.

She posted a video of herself decked out in gold chains and sunglasses, while sitting alongside rapper French Montana, looking like she was just having some fun. And today she`s responding to critics who are reminding her that she`s white. Huh? Back with me again, I know, big time music producer Rodney Jerkins, his wife Joy Enriquez, who is starring in her own reality show, "House of Joy." Now, Rodney, I don`t know, but to me, it looked to me like Miley was just having some fun. I don`t think she was pretending to be someone else. It seems like people love to drink a big gulp of Haterade these days. What`s going on?

ENRIQUEZ: The way I see it is this. Miley wants people to forget about "Hannah Montana." She wants "Hannah Montana" to be out of our memory. And this is her way of getting us to think about Miley Cyrus, not Hannah Montana. And I think she`s doing a good job. Because I don`t, looking at that, I don`t think that`s Hannah Montana at all. I see Miley Cyrus.

TURNER: Absolutely. You know what I want to think about, though? I want to think about your new reality show. Because it looks really, really good. I want to take a look at Rodney in action, trying to write you, Joy, a love song in Spanish. Let`s look.

JERKINS: You know what, I probably go over to Jennifer Lopez`s house couple of times out of the month, but it`s all music related and show related, because she`s executive producer of "House of Joy," and it`s on her network, Nuvo, so we definitely spend time with Jennifer Lopez, and her attorney is Jessica Simpson - they both have the same attorney, and I met with him last week about possibly doing some business with Jessica in the future. So it`s a fun neighborhood.
