BRAD SMITH, ANCHOR, CNN HEADLINE EXPRESS: A plane coming in for a landing hits a truck on a highway and the whole thing was caught on camera. Plus, Rudy Giuliani in the hospital this morning. What we're learning about his condition. We've got those details coming right up.

(BEGIN VIDEO CLIP)

(GUNFIRE)

(END VIDEO CLIP)

SMITH: What started as a party ended in gunfire. The latest out of Texas. And a suspected deadly illness breaks out on a cruise ship, and now, the World Health Organization is investigating. Welcome in everyone, it is Monday, May 4th, I'm Brad Smith, you're watching CNN HEADLINE EXPRESS.

May the force be with all of us today. Let's get started. First this morning, new video of the scary moment that a United plane struck a bakery truck while landing at Newark Airport. And we have two angles that we want to show you. Take a look at this.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Asking that chick --

(COLLISION)

(END VIDEO CLIP)

SMITH: New Jersey state police say that the loud crash you heard was from the plane's engines growing louder before a tire from the plane's landing gear and the underside of the plane hit the truck.

The company says that driver was actually delivering bread products to the airport. The driver was able to pull over and contact his employers and tell him that he had cuts to his arm from the broken glass, but he did not suffer any serious injuries, thank goodness. Another witness captured this video.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Holy --

UNIDENTIFIED MALE: Oh, my goodness --

UNIDENTIFIED MALE: That thing hit that. Did you see all that wind?

UNIDENTIFIED MALE: Oh, my goodness.

(END VIDEO CLIP)

SMITH: New Jersey State police say that the plane also hit a light pole. Air Traffic Control recordings suggest that the pilots and controllers weren't aware of the collision. A flight tracker says that the Boeing 767 was flying from Venice, Italy, and was going more than 160 miles per hour when it crossed over that New Jersey turnpike.

United, here, they're saying that it has launched a full investigation into what happened. Let's go international now. New this morning in the war with Iran, the U.S. will start guiding so-called neutral vessels through the Strait of Hormuz.

Now, this is according to President Trump, and it's all part of a mission called Project Freedom. One official tells CNN, it is not an escort mission. U.S. Central Command announced that the project is aimed at providing military support.

But a senior Iranian military official warns any foreign military in the Strait will be attacked. Even while, this is going on, President Trump describes, quote, "very positive discussions with Iran." CNN's Paula Hancocks has more.

(BEGIN VIDEOTAPE)

PAULA HANCOCKS, CNN INTERNATIONAL CORRESPONDENT (on camera): Now, when it comes to diplomacy, we have heard positive words from the U.S. President again, saying that discussions could lead to something very positive for all.

And we've heard from the Iranian Foreign Ministry spokesperson that the U.S. has responded to Iran's latest proposal. This response going through Pakistan as the mediator, and that Tehran is reviewing that response.

What he did say, though, on state media during a live interview, was that their 14-point proposal that they put forward to the U.S. via Pakistan did not mention the nuclear program at all. This is what Tehran appears to favor at this point to end the war, to open up the Strait of Hormuz.

Clearly, they would like on their terms rather than on U.S.' terms. But to push the issue of the nuclear program to a later date, something which U.S. officials appear not to favor, knowing that if they lift their U.S. Naval blockade of Iranian ships and ports, then they lose a fair bit of leverage.

(END VIDEOTAPE)

SMITH: That was Paula Hancocks reporting from Abu Dhabi. Now, earlier, before President Trump's announcement, a tanker was struck off the coast of Oman by unknown projectiles, according to a U.K.- based maritime agency. All crew are reported safe.

[05:05:00]

And here's how this impacts all of us back home. First, and most notably, it's gas prices. They're on the rise right now, averaging $4.45 a gallon nationwide. That is up 35 cents from just last week alone according to AAA.

And with Iran war negotiations at an impasse, oil prices are pushing towards $110 a barrel this morning. Still, the Trump administration saying it's confident that relief will come once the Strait of Hormuz reopens.

(BEGIN VIDEO CLIP)

SEAN DUFFY, SECRETARY OF TRANSPORTATION, UNITED STATES: Once the Strait opens, you'll see prices come down, come down immediately, and again, there's going to be a tail to that. It's going to take time to get back to where we were before this conflict began. But you're going to see, I think, immediate relief once the Strait opens.

(END VIDEO CLIP)

SMITH: Back here at home, drivers are taking a wait-and-see approach, hoping that the cost of filling their tanks will soon come down. Take a listen.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: With what I think that gas is expensive?

UNIDENTIFIED FEMALE: Yes --

UNIDENTIFIED MALE: I mean, that give it a hard time for the low income and -- low income and the poor people, including myself. Right now, look, it was $4-something, now $5.43. So, even you go to the grocery now, it's very scary --

UNIDENTIFIED FEMALE: Yes --

UNIDENTIFIED MALE: Because before, with a $10, you could have your lunch, but now, everything --

UNIDENTIFIED FEMALE: More expensive --

UNIDENTIFIED MALE: Everything more expensive.

UNIDENTIFIED MALE: With us getting involved in a stupid war --

UNIDENTIFIED FEMALE: Yes --

UNIDENTIFIED MALE: I think that's had a direct -- obviously a direct effect on --

UNIDENTIFIED FEMALE: Yes --

UNIDENTIFIED MALE: The cost of everything here.

UNIDENTIFIED FEMALE: Yes --

UNIDENTIFIED MALE: You know, we're only like putting small amounts of gas in at a time in hopes that the prices are going to come down again soon --

UNIDENTIFIED FEMALE: Yes --

UNIDENTIFIED MALE: But --

(END VIDEO CLIP)

SMITH: Impacting so many there. Another story that we are tracking this morning, former New York mayor Rudy Giuliani is in the hospital in critical but stable condition. The news came Sunday in a statement from his spokesperson, but it did not say why the 81-year-old was hospitalized.

Giuliani told viewers on Friday on his social media show, "America's Mayor Live", that his voice was a little under the weather. He was seen coughing a few times during the streamed program. Former New York Mayor Eric Adams, who left office last year, wished Giuliani a full recovery.

President Trump also sent well wishes to Giuliani, his long-time ally and former personal lawyer, calling him a, quote, "true warrior". Well, today, a federal judge is holding a hearing assessing the conditions where D.C. jail officials held the alleged White House Correspondents' Dinner shooter.

The judge says that he has grave concerns about why Cole Tomas Allen spent days in solitary confinement, including time on suicide watch. Despite his lawyers saying he showed no risk factors. Allen's attorneys have argued that the conditions kept them from meeting privately with their clients, and may have violated his Sixth Amendment Rights.

The Sixth Amendment guarantees defendants a fair and speedy trial and access to legal counsel. Now, this comes just over a week after the shooting at the White House Correspondents' Dinner in Washington.

U.S. Attorney Jeanine Pirro now says that the Secret Service agent injured that night was shot by the suspected gunman, with the bullets striking the officer's bulletproof vest. Video from the night shows an armed man leveling a shotgun at an officer as he rushes through a security checkpoint, though the footage doesn't clearly show that a shot fired.

Pirro says investigators can now prove that the bullet came from the suspect.

(BEGIN VIDEO CLIP)

JEANINE PIRRO, U.S. ATTORNEY FOR DISTRICT OF COLUMBIA: We now can establish that a pellet that came from the buckshot, from the defendant's Mossberg pump-action shotgun was intertwined with the fiber of the vest of the Secret Service Officer --

UNIDENTIFIED MALE: So, it's definitively his fault(ph) --

PIRRO: It is definitively his bullet, he hit at that Secret Service agent. He was -- had every intention to kill him. And anyone who got in his way, on his way to killing the President of the United States. This was a premeditated, violent act calculated to take down the President and anyone who was in the line of fire.

(END VIDEO CLIP)

SMITH: Pirro is also leaving the door open to revive a criminal investigation into a separate case, Fed Chair Jerome Powell. The attorney says that she may reopen the case depending on what a federal inspector general finds in their review of renovations at the Fed.

She paused the probe last week, but tells CNN, she will move forward if the facts justify it. The investigation has drawn political fire and raised questions about pressure on the Fed, as Powell's term nears its end.

Well, a search and rescue operation is underway in Morocco. This is after two U.S. service members went missing during a military training exercise. U.S. Africa Command says it happened Saturday near the city of Tan-Tan, and the military is using ground, air and maritime assets in the search for the missing personnel.

The multinational exercise called Africa Lion 2026 includes troops from multiple North and West African nations.

[05:10:00]

The situation remains under investigation. In this morning's weather express, a new week could bring a new round of storms to the south. Places like Texas, Alabama and Arkansas could all get a burst of severe weather including possible thunderstorms.

CNN meteorologist Chris Warren joins us live now. Chris, when could we see these storms start rolling in?

CHRIS WARREN, CNN METEOROLOGIST: Well, we're seeing storms right now, not quite for the south yet. That's going to come over the next couple of days. Here are the storms right now in Illinois and Indiana moving into Kentucky. And that's the threat for today.

Before the threat for some of the stronger storms, including very large hail, which can be damaging and strong damaging winds, this shift coming down to the south, these are the storms that will be firing by tomorrow afternoon.

And then you can see that continues through the Ohio River Valley and Brad, through parts of Arkansas. Then you go into Mississippi and Alabama for that threat increasing tomorrow, and then again on Wednesday.

SMITH: Chris Warren, a lot to continue to keep tabs on, thanks so much --

WARREN: Yes --

SMITH: For setting us up. Lots more to come on CNN HEADLINE EXPRESS, as well here, more than 60 dogs rescued from a Wisconsin farm after allegations of animal abuse. Why the owners of the farm under fire for years are not facing charges.

And why the makers of an abortion pill have filed an emergency hearing before the Supreme Court. And yes, stranded, stuck, stunned. Spirit Airlines is no more, and the abrupt shutdown had many, maybe even you scrambling for other plans. We've got the latest on the shutdown coming up. Stay with us, you're watching CNN HEADLINE EXPRESS.

(COMMERCIAL BREAK)

[05:15:00]

SMITH: Two people are dead after a mass shooting at an apartment complex in Texas. Listen to the surveillance footage, you can hear people screaming as dozens of gunshots ring out.

(BEGIN VIDEO CLIP)

(GUNFIRE)

UNIDENTIFIED MALE: (INAUDIBLE)

(FEMALE SCREAMING)

(END VIDEO CLIP)

SMITH: Now one person died at the scene early Saturday morning, another later died at the hospital. According to investigators, the shooting began after a group of minors and young adults left a party and returned to the complex.

Another group from that party followed them home and tried to enter an apartment there. Police say, that's when someone opened fire with a rifle-style weapon. With less than two months to go until the California primary, a new poll offers a glimpse at what voters are looking for in their next governor. According to the "CBS" and YouGov poll, 77 percent of respondents say

that they want their next governor to share their values. Take a look at these numbers here, 56 percent are looking at experience, 52 percent say judgment matters most to them, and nearly half of all correspondents want change.

To say the least, California's primary is well, unusual. So, we asked CNN's Elex Michaelson to explain it to us.

(BEGIN VIDEOTAPE)

ELEX MICHAELSON, CNN REPORTER (on camera): What is a jungle primary? It's an unusual system that could lead to a November general election without any Democratic candidate for governor in deep blue California.

Now, most states have party primaries. For example, Democrats vote for Democrats and the primary to pick a Democratic nominee, Republicans vote for Republicans to pick a Republican nominee. But California is one of the handful of states that has a top two primary system.

Where all voters use the same ballot, which lists all the candidates running for governor across parties rather than just Democrats or just Republicans, and then the top two finishers advance to the general election, regardless of their party.

That means the general election could be a Democrat and Republican or two Democrats, or even two Republicans. And this year, there are so many Democrats running in California, that it's mathematically possible that they split up the vote so much that Republican candidate Steve Hilton and Chad Bianco end up making the general election against each other and boxing out the Democratic Party altogether.

It's unlikely, but it's not impossible. Now, this whole idea of the jungle primary was pushed by then Governor Arnold Schwarzenegger, and it was passed by California voters with the hope of making California's elections less partisan.

And it is why all seven leading candidates from both parties will be on stage together for one unpredictable debate on Tuesday night.

(END VIDEOTAPE)

SMITH: And in fact, Elex Michaelson and Kaitlan Collins will host that debate. We hope that you tune in 9:00 p.m. Eastern Time tomorrow night on both CNN and "CNN ALL ACCESS". Well, still to come on CNN HEADLINE EXPRESS, take a look at this.

Body-cam captures the moment a firefighter desperately tries to pull a woman from this burning car in the middle of the highway, wait until you hear the details there. And a viral outbreak on a cruise ship that leaves three dead and several others ill.

Now, a massive investigation is underway into what caused the deadly infection. Stay with us, you're watching CNN HEADLINE EXPRESS.

[05:20:00] (COMMERCIAL BREAK)

SMITH: Three people are dead and three others are sick after a suspected hantavirus outbreak on a cruise ship. No passengers are being allowed off while health officials investigate. The ship is currently anchored off the coast of Cape Verde in West Africa.

The World Health Organization says at least one case of the rare virus has been confirmed so far. The illness is linked to exposure to infected rodents. We spoke with a doctor who called this outbreak highly unusual.

[05:25:00]

(BEGIN VIDEO CLIP)

SCOTT MISCOVICH, PHYSICIAN: This could really change the future of travel medicine and infectious disease and tropical medicine, because we now have to add this list to something that could come in and rip through a cruise ship.

(END VIDEO CLIP)

SMITH: The company, Oceanwide Expedition says that the passengers are not being allowed to disembark, but medical officials have boarded the boat. South African health officials say a married couple are among those who died.

The ship left Argentina with about 150 passengers for a cruise that included a stop in Antarctica, and was on its way to Spain's Canary Islands. Well, thousands of travelers are scrambling to find new flights after Spirit Airlines abruptly shut down over the weekend, effectively ending customer service.

Passengers who already paid for trips arrived to empty kiosks at airports across the country. Many had to find alternative flights on different airlines, and some haven't been refunded yet for their Spirit tickets.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Can get transferred, they didn't transfer over, they didn't offer any type of help, any type of like accommodations. Nothing like that. Just your flight has been canceled.

UNIDENTIFIED FEMALE: And they literally said, don't come to the airport --

UNIDENTIFIED FEMALE: Don't come to the airport is what they said --

UNIDENTIFIED FEMALE: Why did they say that?

UNIDENTIFIED FEMALE: Do not come to the airport.

UNIDENTIFIED FEMALE: We came here to the airport to try to get another ticket, American Airlines is like $1,300. And then I hear for Frontier that they're only helping customers until June 6th. Well, my flight is all into the 18th.

I haven't even received my money back to even buy a new ticket. So, that means I've got to come out-of-pocket with more money to purchase another ticket.

(END VIDEO CLIP)

SMITH: Major airlines are stepping in to help. United, Delta, JetBlue, Southwest are capping fares, while Frontier is offering 50 percent off base tickets through Sunday. But experts warn this could still mean higher prices and fewer options ahead.

Well, dozens of dogs are being removed from a Wisconsin farm at the center of animal abuse allegations. More than 60 Beagles are now on their way to rescue groups in New York and Virginia.

Rick Glenn(ph) Farms has denied abuse allegations, and under a settlement, the owners will give up their state breeding license and in exchange will not face criminal charges. Overall, about 1,500 dogs will be rescued.

Finding hopefully a forever home out there soon. Straight ahead on CNN HEADLINE EXPRESS, pop star Britney Spears facing DUI charges expected to be arraigned in a California courtroom later today. We've got that story and more. CNN HEADLINE EXPRESS continues.
