Was Winona Ryder Framed?

MILES O'BRIEN, CNN CORRESPONDENT: So, here's the question on your mind this morning, was Winona Ryder framed? And not by a movie camera. That's what her defense lawyers are hinting. A Beverly Hills jury may get Ryder's shoplifting case on Monday. Defense attorneys say they're nearly finished with their case. Still no word on whether the movie star will take the stand.
CNN's Thelma Gutierrez is watching the trial.

THELMA GUTIERREZ, CNN CORRESPONDENT (voice-over): Actress Winona Ryder got her day in court Friday as the defense started calling witnesses. The key witness, a former Saks Fifth Avenue employee.
MICHAEL SHOAR, FORMER SAK'S EMPLOYEE: Well, he was very excited about the case.
GUTIERREZ: Michael Shoar testified the head of security for Saks, Kenneth Evans, told him he was out to get Ryder.
SHOAR: On the phone he told me that he would nail, he has nailed this Beverly Hills bitch and also when I saw him in person at the restaurant, he told me that he would make enough evidence to bring her down for this case.
GUTIERREZ: During cross-examination, the prosecution asked Shoar if he had an axe to grind with Saks. His response? "Yes, I do."
ANTHONY SALERNO, CRIMINAL DEFENSE ATTORNEY: It was an absolute disaster for the defense. It appeared when the direct examination of Mr. Shoar was completed by Mark Geragos that this was going to be the star witness for the defense. And then no sooner did that happen but then he was absolutely destroyed by the prosecutor.
GUTIERREZ: Outside of court, Shoar told reporters he did not have an axe to grind with his former employer.
SHOAR: No, I don't have an axe to grind with Saks. I just want to make my point across.
GUTIERREZ: Geragos also focused his attention on this claim made by Beverly Hills Police Lieutenant Gary Gilmond a day after Ryder's arrest last December.
LT. GARY GILMOND, BEVERLY HILLS POLICE: The security officers observed both visually and by video Ms. Ryder to remove sensormatic tags, which are the security tags.
GUTIERREZ: Geragos said the store security tapes show no such thing and questioned Lieutenant Gilmond's motive. Under cross- examination, Gilmond testified he based his statement to the media on a written report by a Saks Fifth Avenue security guard and thought the security cameras had captured Ryder cutting sensor tags off merchandise. It was an error.
SANDY GIBBONS: I'm the public information officer for the...
GUTIERREZ: Sandy Gibbons, a spokeswoman for the L.A. County D.A.'s office, also released this statement from the D.A. early this year. It mentions the claim by Beverly Hills police that Ryder was captured on camera cutting security tags off merchandise. Geragos questioned the motive of the D.A.'s office. Under cross-examination, Gibbons simply testified it was her error and she had never seen the tape.
With so much at stake for the actress, the big question is will Ryder take the stand in her own defense on Monday? Ryder's attorney told CNN he will consider that option this weekend, but added he felt that at this point he had produced reasonable doubt.
