New Jersey Home Owner Heads to Court Over Dog

ANDERSON COOPER, CNN ANCHOR: Home owners in New Jersey are holding their noses over what dogs are leaving behind on their lawns, need we say more. A judge has been called on to try to settle things. Frank Cipolla from CNN affiliate WWOR tells us the story.
(BEGIN VIDEOTAPE)

FRANK CIPOLLA, WWOR CORRESPONDENT (voice over): Gucci (ph) is a good dog. So is it's owner. Other dog owners in and around Leonia, New Jersey however have not been so good.

CAROLINE CALDERONE, RESIDENT: When I see that they leave their calling cards behind that calls the owner's attention, they come out and I'm like hey what about this.

CIPOLLA: In fact the problem of dogs leaving their calling cards behind along Glenwood Drive in Leonia has gotten so bad that one home owner is heading to court to settle this ongoing dispute over what dogs do and his neighbors are right behind him.

SAITTA: There are dogs. We don't know who they are. We can't catch them that are pooping all over our sidewalk.

CIPOLLA: The owner of this house says he has seen dog owners make this small strip of grass between the sidewalk and the curb the final destination of last night's doggie dinner, sometimes picking up what's left behind, sometimes not.

CIPOLLA (on camera): And this is no laughing matter. In fact, the homeowner William Ramos (ph) claims that he and the dog walker actually got into a heated argument right here in his driveway over whether or not the dog took care of business in front of his house.

(voice-over): Ramos (ph), who would not speak with us on camera, says he's heading to court to determine whether this strip of grass between the sidewalk and the curb is public or private property. The law says dog owners can use public property for their dogs, but if a dog uses private property to relieve itself, the dog owner needs the home owner's permission first.

Either way...

UNIDENTIFIED MALE: It's a really stinky story.

UNIDENTIFIED FEMALE: Isn't it?
